HomeMy WebLinkAboutResolution No. 5416RESOLUTION NO. 5416 RESOLUTION OF THE CITY OF SAN RAFAEL DESIGNATING PARKING SPACES FOR DISABLED PERSONS AND ENFORCING ILLEGAL USE OF DESIGNATED SPACES FOR THE DISABLED PURSUANT TO CALIFORNIA VEHICLE CODE SECTIONS 22511.7 AND 22511.8 WHEREAS, California Vehicle Code Sections 22511.7 and 22511.8 provide, respectively, for designation of vehicles for disabled persons and veterans and for sanctions which may be levied or imposed upon unauthorized vehicles illegally parking in spaces provided for disabled persons; and, WHEREAS, the referenced enabling legislation authorizes local governmental entities to enforce violations of illegal use of parking spaces designated for disabled persons by unauthor- ized vehicles; and, WHEREAS, pursuant to said enabling legislation, the San Rafael City Council hereby adopts the following provisions enforcing parking spaces on both public and private property, designated for disabled persons. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN RAFAEL THAT the following provisions enforcing violations of illegal parking in spaces designated for disabled persons on public and private property, pursuant to California Vehicle Code Sections 22511.7 and 22511.8, are hereby adopted: SECTION 1. ON -STREET PARKING The Director of Public Works shall designate special "blue curb" parking spaces for the purpose of providing on -street parking for exclusive use by disabled persons. SECTION II. OFF-STREET/PUBLICLY OWNED FACILITIES The Director of Public Works shall designate parking stalls or spaces in publicly owned, leased, or controlled off- street parking facilities for exclusive use by disabled persons. SECTION III. USE OF BLUE CURB SPACES Persons using "blue curb" parking spaces shall comply with the following: 1. No person shall park or stand any vehicle in a disabled person's parking zone (blue curb) unless said vehicle bears a special license or displays a special placard issued under the provisions of Section 9105 or Section 22411.5 of the California Vehicle Code. 2. Blue curb parking spaces shall be operative twenty-four (24) hours a day Sundays and holidays included. 3. Parking zones for the disabled are subject to any temporary parking prohibitions established by the City. SECTION IV. OFF-STREET/PRIVATELY FINANCED FACILITIES The San Rafael City Council hereby declares that the following are or contain privately owned and operated parking facilities which may reserve parking stalls for exclusive use by disabled persons: 1. Northgate Shopping Center No. 1 (Address to be supplied) 2. Northgate Shopping Center No. 2. (Address to be supplied) 3. Northgate Shopping Center No. 3 (Address to be supplied) 4. Holiday Plaza (Address to be supplied) 5. Scotty's Market (Address to be supplied) 6. Montecito Shopping Center (Address to be supplied) 7. United Market (Address to be supplied) 8. Yard Bird (Address to be supplied) 9. Alpha Beta Market (Address to be supplied) 10. Kaiser Hospital (Address to be supplied) 11. Macy's (Address to be supplied) 12. Court House Square (Address to be supplied) 13. Sil's Market (Address to be supplied) 14. Safeway Market (Address to be supplied) -2- SECTION V. IDENTIFICATION 1. On -Street - Blue Curb Spaces Blue curb spaces shall be indicated by blue paint on the curb edge of the paved portion of the street. For further identification, the International Symbol of Access may be painted on the blue curb in white followed by the word "ONLY." 2. Off-Street/Publicly Owned Facilities Designation of "blue curb" parking stalls in publicly financed or municipally owned off-street parking facilities shall be made by posting immediately adjacent to, and visible from same, a sign consisting of the International Symbol of Access. In addition a sign not less than 17" x 22" in size must be posted immediately adjacent to and visible from the reserved stall(s) which states with lettering not less than one inch in height: "Unauthorized vehicles not displaying distin- guishing license plates or placards issued for physically handicapped persons will be issued citations." 3. Off-Street/Privately Financed Facilities Designation of "blue curb" parking stalls in privately financed off-street parking facilities shall be made by posting immediately adjacent to and visible from same a sign consisting of the International Symbol of Access. In addition, a sign not less than 17" x 22" in size with lettering not less than one inch in height which clearly states: "Unauthorized vehicles not displaying distin- guishing license plates or placards issued for physically handicapped persons will be issued citations." This sign shall be posted at each entrance to the parking facility. -3- SECTION VI. BAIL FOR VIOLATIONS The bail for violation of those California Vehicle Code Sections prohibiting unauthorized vehicles from parking in spaces designated for disabled persons shall be $25.00, or as determined by the Marin County Municipal Court in a uniform bail schedule for such violations.
