HomeMy WebLinkAboutResolution No. 5473RESOLUTION NO. 5473 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL TO COMPLY WITH SEC. 33433 OF THE CALIFORNIA HEALTH & SAFETY CODE REGARDING THE AMENDED LEASE AND SALE TO SIDNEY HENDRICKS The City of San Rafael, hereinafter referred to as City, and the San Rafael Redevelopment Agency, hereinafter referred to as Agency, having conducted a joint public hearing upon the above entitled matter upon due notice, and the City and/or the Agency having heard all persons, objections and recommendations relative thereto, and having fully considered the same, do hereby declare, find and determine that: 1. WHEREAS, California Health and Safety Code Section 33433 requires that the sale or lease of any Agency acquired property which was purchased in whole or part with tax increment monies, must first be approved by the legislative body after a public hearing; and 2. WHEREAS, the Agency will, or has approved an "Agreement for the Lease, Development and Disposition of Property"; and 3. WHEREAS, the City and Agency have caused two (2) public notices of this meeting to be published a week apart in a newspaper of general circulation within the area, the first notice at least two weeks prior to the call of the meeting; and 4. WHEREAS, the City and Agency have made available a read- ing file, in conformance with Section 33433 of the California Health and Safety Code, to the public at the office of the City Clerk, 1400 Fifth Avenue, San Rafael, and the Agency office at 1313 Fifth Avenue, San Rafael, NOW THEREFORE, the City takes the following action: RESOLVED, the Agency and/or City approves of the Agency entering into an "Agreement for the Lease, Development and Disposition of Property" for lands described in "Exhibit A" attached hereto (A.P. 14-122-06,07,08,09,10 & 11). I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a REGULAR meeting of the members of said Council held on the fifth day of June ,1978, by the following vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None J E M. LEONCINI, ity Clerk All that certain real property situated in the City of San Rafael, County of Marin, State of California described as follows: PARCEL 1 (A.P. 14-122-10) BEGINNING at the point of intersection of the Northerly line of Third Street with the Westerly line of Irwin Street; thence Northerly along said Westerly line of Irwin Street, 23 feet 9 inches to the Southerly line of the land of Carolina B. Raulino; thence Westerly along the Southerly line of said Raulino land, 91 feet, more or less, to the Southwest corner of said Raulino land; thence Southerly parallel with the Easterly line of Tamalpais Avenue, 24 feet 6 inches, more or less, to the Northerly line of Third Street; thence Easterly along the Northerly line of Third Street, 91 feet to the point of beginning. BEING a portion of Block 51 of the City of San Rafael. Also all Grantors right, title and interest in the publicway adjoining and appurtenant to the above-described real property. PARCEL 2 (A.P. 14-122-09) BEGINNING at a point on the Westerly line of Irwin Street, 23.9 feet North of the point of intersection of said line with the Northerly line of Third Street; thence Northerly along said line, 28 feet 51-2 inches; thence Westerly, parallel with Third Street, 91 feet; thence Southerly parallel with Irwin Street, 27 feet 6 inches; thence Easterly parallel with said Third Street, 91 feet to the point of beginning. BEING a por- tion of Block 51 as shown on the Map of the City of San Rafael surveyed by Hiram Austin, CE, October 14, 1873. PARCEL 3 (A.P. 14-122-08) BEGINNING at a point on the Westerly line of Irwin Street, Dis- tant Northerly 52.2 feet from the point of intersection of said Street with the Northerly line of Third Street; thence North- erly along said Westerly line, 26 feet, more or less, to the Southeasterly corner of the parcel described in the Deed to James Tunstead, recorded in Book 31 of Deeds at page 397; thence Westerly along the Southerly line of said Tunstead parcel, 91 feet; thence Southerly parallel with the Westerly line of Irwin Street, 26 feet; thence Easterly 91 feet to the point of begin- ning. PARCEL 4 (A.P. 14-122-07) BEGINNING at a point on the Westerly line of Irwin Street, dis- tant 180 feet Southerly from the point of intersection of said line with the Southerly line of Fourth Street; thence Southerly along the Westerly line of Irwin Street, 40 feet; thence Westerly and parallel with Third Street, 91 feet, more or less, to the Westerly line of the parcel of land conveyed to James Tunstead and Hepburn Wilkins by Deed recorded March 31, 1894 in Book 30 of Deeds at page 53; thence Northerly along said Westerly line, 40 feet; thence Easterly parallel with Third Street, 91 feet, more or less, to the point of beginning. PARCEL 5 (A.P. 14-122-11) BEGINNING at a point on the Northerly line of Third Street, distant 91 feet Westerly from the Northwest corner of Third and Irwin Streets; thence Northerly and parallel with Irwin Street, 148-1/2 feet, more or less, to the Southeast corner of the parcel described in the Deed to Frank Healy, recorded June 5, 1890 in Book 12 of Deeds at page 99; thence Westerly along the Healy parcel, 30 feet; thence Southerly 148-1/2 feet, more or less, to the Northerly line of Third Street; thence Easterly along said Northerly line, 30 feet to the point of beginning. BEING a portion of Block 51 of the City of San Rafael. PARCEL 6 (A.P. 14-122-06) Beginning at a point in the Westerly line of Irwin Street, 140 feet Southerly from the point of intersection of said Westerly line with the Southerly line of Fourth Street; thence Southerly along said Westerly line, 40 feet; thence Westerly and parallel with Fourth Street, 91 feet, more or less, to the Easterly line of the lands formerly owned by James Tunstead and Hepburn Wilkins; thence Northerly along said Easterly line, 40 feet; thence Easterly 91 feet, more or less, to the point of beginning. Being a portion of Block 51, of the City of San Rafael.
