RESOLUTION OF AWARD OF CONTRACT, SMITH RANCH ASSESSMENT
DISTRICT NO. 1, CITY OF SAN RAFAEL, MARIN COUNTY,CALIFORNIA
WHEREAS, by resolution adopted on May 1, 1978, it was
directed that bids be called for the improvement work to be done in
Smith Ranch Assessment District No. 1, City of San Rafael, Marin
County, California, and that the time fixed for receiving sealed
bids or proposals was the 23rd day of May, 1978, at the hour of 2:00
o'clock P.M. of said day; and
WHEREAS, Notice Inviting Sealed Bids was duly published in
the time and manner required by law; and
WHEREAS, all bids having been publicly opened, examined and
declared pertaining to the doing of the work and improvements de-
scribed in the Resolution of Intention, as amended, which Resolution of
Intention, as amended, is hereby expressly referred to for a descrip-
tion of said improvements, and for all other particulars relative to
the proceedings under said Resolution of Intention, as -amended; and
WHEREAS, all bids having been referred to the Engineer
of Work for review and recommendation, and said Engineer of Work having
reviewed said bids and presented an analysis and recommendation re
award of bids; and
WHEREAS, the City Council of the City of San Rafael having
considered said analysis and recommendation and having determined that
the bid recommended for award was submitted in accordance with said
Notice Inviting Sealed Bids; and
WHEREAS, the City Council of the City of San Rafael, on the
5th day of June, 1978, ordered the improvements to be made in said
assessment district;
NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council
of the City of San Rafael hereby rejects all of said proposals or bids
except that herein mentioned, and hereby awards the contract for said
improvements to the lowest responsible bidder, to wit:
TYLER-ENGELKE CORPORATION
at the prices named in the bid of said bidder on file in the office of
the City Clerk of the City of San Rafael; and
IT IS HEREBY DIRECTED that the City Clerk of the City of San
Rafael publish a Notice of Award of Contract.
IT IS HEREBY FURTHER AUTHORIZED AND DIRECTED that the Mayor
and the City Clerk of the City of San Rafael execute the written
contract for said improvements upon presentation by said bidder of
the required bonds and certificates of insurance; provided that the
required bonds be in substantially the form approved by the Insurance
Commissioner of the State of California, and that said bonds and certi-
ficates be approved by special bond counsel.
I HEREBY CERTIFY that the foregoing resolution was duly and
regularly adopted by the City Council of the City of San Rafael, Marin
County, California, at a regular meeting thereof, held on the 5th day
of June, 1978, by the following vote, to wit:

NOES: Councilmembers None
ABSENT: Councilmembers Nixon
