HomeMy WebLinkAboutResolution No. 5498RESOLUTION NO. 5498 RESOLUTION OF THE CITY OF SAN RAFAEL SUPPORTING CENTRAL MARIN COUNTY WASTEWATER FACILITIES PLAN ALTERNATIVE CM -5 WHEREAS, the sewering agencies of Eastern Marin and Southern Sonoma Counties have been conducting studies directed toward determining the best and most economical means of meeting individual and combined clean water needs; and WHEREAS, a series of studies since 1972 have defined and evaluated a wide range of alternatives, involving degrees of area -wide consolidation and independent action; and WHEREAS, the current Facilities Plan and related draft Environmental Impact Report/Statement has been subjected to public hearings, which hearings resulted in a number of addi- tional factors being presented for question and consideration; and WHEREAS, the result of the re-evaluation of factors surrounding the previously proposed Alternative Plan reported upon in the Facilities Plan and related Environmental Impact Report/Statement indicates that the public's best interest will be served through a consolidation Alternative, involving joint use of a single, subregional wastewater treatment plant described as Alternative CM -5; and WHEREAS, the directly affected Central Marin public agencies within the Central Marin service area have studied the alternatives through a representative "Ad Hoc" Committee; and WHEREAS, the "Ad Hoc" Committee has concluded and confirmed that the consolidation Alternative CM -5 is clearly the best alternative plan to meet the combined clean water needs of Central Marin County; and WHEREAS, the viability of the consolidation Alternative Plan CM -5 is dependent upon gaining State and Federal Clean Water grant approvals through the State Water Resources Control Board; NOW, THEREFORE, BE IT RESOLVED THAT the City of San Rafael hereby indicates its support of the consolidation Alterna- tive Plan CM -5 to the State Water Resources Control Board and hereby petitions approval of Alternative Plan CM -5 for purposes of grant funding; and BE IT FURTHER RESOLVED THAT, as evidence of confidence and good faith, the City of San Rafael declares, contingent upon State Water Resources Control Board approval of Alternative Plan CM -5 for grant funding, its willingness to support steps toward implementation of Alternative Plan CM -5, including appropriate agreements between participating agencies, for securing the site of the proposed consolidated wastewater treatment plant and carrying forward Step 2 and Step 3 projects, as well as agreements necessary for continuing operation and maintenance of joint use facilities, with the condition that the City of San Rafael will not pay for any of the costs of the site acquisition or of construction of the new facilities.
