A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL ORDERING AN ANNEXATION OF TERRITORY
PURSUANT TO THE MUNICIPAL ORGANIZATION ACT -
THREE RED ROCK WAY (WILTSHIRE REORGANIZATION)
WHEREAS, Shaun Wiltshire made application to the Marin Local Agency
Formation Commission for approval of an annexation proposal; and
WHEREAS, the Marin Local Agency Formation Commission, by Resolution
No. 78-11, adopted on June 8, 1978, approved said annexation and designated
the City of San Rafael as the conducting agency for further proceedings; and
WHEREAS, this application was accompanied by written consent signed by
all owners of land within the territory proposed for annexation and the Local
Agency Formation Commission authorized the conducting agency to complete
further proceedings with waiver of notice, hearing and election requirements; and
WHEREAS, said annexation, known as the Wiltshire Reorganization, consists
of pre -zoning from County A -2:B-4 to City of San Rafael R -1-B-4; and
WHEREAS, the subject territory which is uninhabited is located in the County
of Marin and is more specifically described in the map and legal description
attached to this resolution;
NOW, THEREFORE, BE IT RESOLVED by the San Rafael City Council that:
Section 1. This proposal is approved for annexation to the City of San
Rafael and the San Rafael Sanitation District with simultaneous detachment from
County Service Area No. 19 subject to the following terms and conditions:
That the annexation territory shall be withdrawn from County
Service Area No. 19 pursuant to Section 25210.90 of the Government Code which
provides that territory in a county service area which is included within a city
by reason of annexation shall be automatically excluded from the county service
area upon the effective date of its inclusion in the City.
Section 2. The annexation is proposed for the following purposes: Obtain
municipal and district services for which property owner is presently ineligible.
The Clerk of the City of San Rafael is hereby directed to file a certified
copy of this resolution with the Executive Officer of the Local Agency Formation
Commission of the County of Marin.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that
the foregoing resolution was duly and regularly introduced and adopted at a
regular meeting of the Council of said City on Monday , the 17th day of
July , 1978, by the following vote, to wit:

Beginning at a point on the existing San Rafael Sanitation District, said
point being the northeasterly corner of the property described in the deed
from Title Insurance & Trust Company to Frank G. McCabe, et ux, recorded
August 21, 1962 in Book 1603 of Official Records at Page 310; thence along
said Sanitation District boundary southeasterly, southwesterly, northwesterly,
southwesterly and northeasterly to a point on the westerly right of way line
of the Northwest Pacific Railroad, Book 2 of Surveys at page 116, Aurin County
Official Records; thence leaving San Rafael Sanitation District boundary along
said Railroad Right of Way N 470 10' 40" W, 84.51 feet to the southerly line
of Los Ranchitos Road as shown on said map; thence along said southerly line
along a curve whose radius point bears N 30° 24' 52" 11, a distance of 360.00
feet, an arc distance of 112.195 feet and having a central angle of 17° 51' 23";
thence leaving said southerly line of Los Ranchitos Road along a curve whose
radius point bears S 12° 33' 29" E, 20.00 feet, an arc distance of 23.163 feet
and having a central angle of 66° 21' 29"; thence along the southeasterly line
of Red Rock Way S 36° 12' tiV, 97.16 feet; thence along a curve whose radius
point bears N 51° 32' 37" IV, 115.00 feet an arc distance of 4.53 feet and having
a central angle of 2° 15' 23" to the point of beginning.
Containing approximately 1.50 acres.
