RESOLUTION ORDERING VACATION OF PART OF PUBLIC STREET
WHEREAS, the City Council of the City of San Rafael, on
the 5th day of June, 1978, passed and adopted Resolution No. 5475,
entitled "RESOLUTION OF INTENTION TO ORDER VACATION OF PART OF
PUBLIC STREET", and
WHEREAS, notice was published and posted as required by
law, and
WHEREAS, a hearing was had this day as required by law, and
said Resolution No. 5475, at which hearing the Council of the City
of San Rafael heard evidence offered by all persons interested in
or objecting to the vacation hereinafter ordered, and
WHEREAS, it appears from the evidence offered and from all
of the evidence submitted, and the said Council finds, that the part
of the street herein described is unnecessary for present or pros-
pective public street purposes,
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED that the
part of the public street, to wit: Surplus Portion of North San Pedro
Road (old "San Pedro Avenue") at Merrydale Road, located in the City
of San Rafael, California, which part of said street is hereinafter
more particularly described, is unnecessary for present or prospective
public street purposes and is hereby vacated.
The part of the public street proposed to be vacated is
located in the City of San Rafael, State of California, and is a
surplus portion of North San Pedro Road (old "San Pedro Avenue") and
is more particularly described as follows:
COMMENCING at the easterly corner of Lot 18 in Block 28,
as said lot and block are shown on the Map entitled "Map
of Subdivision 'A' of Golf Links Tract", filed January 14,
1908, in Map Book 2, Page 107, in the Office of the
Recorder of Marin County; thence along the southeasterly
prolongation of the northeasterly line of said Lot 18 S.
29°10'11" E., 50.00 feet to the southeasterly line of San
Pedro Avenue, as said Avenue is shown on said Map; thence
along the last said line S. 60°49149" W., 156.63 feet;
thence S. 75016150" W., 16.24 feet; thence N. 23055103"
W., 11.74 feet; thence S. 66004157" W., 31.63 feet; thence
along a tangent curve to the right with a radius of
70.00 feet, through an angle of 51031139", an arc length
of 62.95 feet to the northwesterly line of said San Pedro
Avenue; thence along last said line N. 60049149" E., 254.93
feet to the point of commencement.
Reserving, however, to Pacific Gas and Electric Company
the right from time to time to install, maintain, repair,
operate, replace, remove and renew a line of pipes and other
structures, equipment and fixtures, both above ground and
underground, for the operation of said facilities in said
road.
BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby
authorized to execute on behalf of the City of San Rafael a quitclaim
deed to the State of California conveying City's rights in said sur-
plus portion of North San Pedro Road.

fornia, hereby certify that the foregoing resolution was duly and
regularly introduced and adopted at a regular meeting of the Council
of said City held on the 17th day of July, 1978, by the following
vote, to wit:
