A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
ORDERING VACATION OF LINDEN LANE BETWEEN MOUNTAIN VIEW
AVENUE AND LOCUST AVENUE, SAN RAFAEL, CALIFORNIA
WHEREAS, the City Council of the City of San Rafael, on
the 18th day of September, 1978, passed and adopted Resolution No.
5551, entitled, "RESOLUTION OF INTENTION TO ORDER VACATION OF
PUBLIC STREET," and
law, and
WHEREAS, notice was published and posted as required by
WHEREAS, a hearing was had this day as required by law,
and said Resolution No. 5551, at which hearing the Council of the
City of San Rafael heard evidence offered by all persons interested
in or objecting to the vacation hereinafter ordered, and
WHEREAS, it appears from the evidence offered and from all
of the evidence submitted, and the said Council finds, that the
street herein described is unnecessary for present or prospective
public street purposes,
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED that
LINDEN LANE, between Mountain View Avenue and Locust Avenue, located
in the City of San Rafael, California, hereinafter more particularly
described, is unnecessary for present or prospective public street
purposes and is hereby vacated subject to the following conditions:
1.) The underlying fee owners shall within 60 days
of this action file a parcel map with the City
which shall show the division of the land aban-
doned_
2.) Prior to approval of the parcel map by the City
the transfer of ownership of the various parcels
to abutting property owners shall be completed to
the satisfaction of the City.
The public street proposed to be vacated is located in the
City of San Rafael, State of California, designated as LINDEN LANE,
and is a parcel of land, 60 feet wide, more particularly described
as follows:
Bounded on the NORTHWEST by Mountain View Avenue;
bounded on the SOUTHEAST by Locust Avenue; bounded
on the SOUTHWEST by the parcel granted to R. Bok
Reitzel and wife, by deed recorded September 16,
1968 in Book 2240 of Official Records at page 401
and by the parcel granted to Dean F. Reitzel by deed
recorded February 14, 1975 in Book 2868 of Official
Records at page 498; bounded on the NORTHEAST by the
parcel granted to Edward L. Henley and wife, by deed
recorded March 31, 1977 in Book 3175 of Official
Records at page 508 and by the parcel granted to
Dominican College of San Rafael, a corporation, by
Deed recorded January 31, 1966 in Book 2013 of Offi-
cial Records at page 390.
Reserving, however, to Marin Municipal Water District
a right-of-way for pipeline or pipelines twenty (20)
feet in width lying ten (10) feet on each side of the
following described line:
BEGINNING at a point in the Northerly line of Locust
Avenue which point bears along the arc of a curve to
the right whose center bears South 291 55' 42" East
with a radius of 252.42 feet for an arc distance of
10,000 feet from the intersection point of the Southerly
line of Linden Lane with the Northerly line of Locust
Avenue as said intersection point is delineated on that
certain map entitled, "Record of Survey, Portion of
Lot 14-1/2 Coleman's Addition RM 1-39", recorded March
19, 1969 in Book 8 of Surveys at Page 21, Marin County
Surveys, running thence FROM SAID POINT OF BEGINNING
North 250 20' 00" West 425.0 feet more or less to the
Southerly line of Mountain View Avenue.
Also reserving to the City of San Rafael, a 60 foot -wide
drainage easement in Linden Lane running Southeasterly
from the southerly line of Mountain View Avenue, 175
feet more or less to the northerly bank of the creek
traversing Linden Lane, and a public utilities easement
over the entire area abandoned for underground facilities
only.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council
of said City on Monday , the 16th day of October
19 78, by the following vote, to wit:
