RESOLUTION ORDERING CLOSING, ABANDONING
AND VACATING VARIOUS EASEMENTS
WHEREAS, the City Council of the City of San Rafael on the
17th day of July, 1978, adopted Resolution No. 5515 entitled,
RESOLUTION OF INTENTION TO VACATE VARIOUS EASEMENTS; and
WHEREAS, said Resolution was posted as required by law; and
WHEREAS, the Department of Public Works of the City of San
Rafael, California, conspicuously posted notices of easement vaca-
tion as required by law; and
WHEREAS, a hearing was had this day as required by law and
said Resolution No. 5515, at which hearing the Council of the City
of San Rafael heard evidence offered by persons interested; and
WHEREAS, it appears from all of the evidence submitted that
the following described easements are unnecessary for present or
prospective public use;
NOW, THEREFORE, IT IS HEREBY RESOLVED as follows:
1. That the following described easements are unnecessary
for present or prospective public use;
2. That the following described easements are hereby ordered
closed, abandoned and vacated subject to the City receiving a 20 foot -
wide access easement to the lagoon along the southerly line of lot 25,
Peacock Lagoon Unit One.
3. That the easements closed, abandoned and vacated are
described on Exhibit "A" which is attached hereto and incorporated
herein by reference.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing Resolution was duly and regularly intro-
duced and adopted at a regular meeting of the Council of the City of
San Rafael held on the 6th day of November , 1978, by the following
vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini.
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: None

EXHIBIT A
DESCRIPTION OF DRAINAGE EASEMENT AND FLOOD EASE%IENT
TO BE ABANDONED ON LOT 25 - PEACOCK LAGOON UNIT ONE
The easements to be abandoned are described as follows:
A drainage easement and flood easement occupying portions
of Lot 25 as shown on the map entitled, "Peacock Lagoon
Unit One", recorded July 17, 1962, in Volume 11 of Maps
at Page 24, Marin County Records; said Lot 25 not being a
part of said subdivision.
Excepting therefrom, however, a 15 foot wide drainage
easement (subject to inundation) on said Lot 25 parallel
with and adjacent to the courses N 62°54' W and N 431221 �T
as shown on said map.
