HomeMy WebLinkAboutResolution No. 5568RESOLUTION NO. 5568 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a contract, lease or agreement with SAN RAFAEL CITY SCHOOLS - JOINT POWERS AGREEMENT REGARDING USE OF FACILITIES AND FIELDS - MEMORANDUM OF UNDERSTANDING a copy of which is hereby attached and by this reference made a part hereof. I, JEANNE M. LEONCINI, City Clerk 1/78 -CC REFERENCE IEMORANDUM OF UNDERSTANDIN SAN RAFAEL RECREATION CITY SCHOOLS DEPARTMENT JOINT POWERS AGREEMENT - DATED SEPTEMBER 5, 1978 BETWEEN SAN RAFAEL CITY SCHOOLS AND THE CITY OF SAN RAFAEL The following conditions for implementation of the September 5, 1978 Joint Powers Agreement are acceptable to both parties as attested to by signatures of agency representatives. 1. DEFINITION: For the purposes of this document, Facilities and Multi - Purpose Rooms refers to Gymnasiums; Fields includes Tennis Courts. 2. LOCATION OF FACILITIES OR FIELDS TO BE SCHEDULED BY THE SAN RAFAEL RECREATION DEPT.: Facilities and fields are located at San Rafael High School, Terra Linda High School, Santa Venetia Middle School and David- son Middle School. Elementary school playfield sites are also included. Specific facilities or fields excluded from this agreement are the High School Swimming Pools, Miller Field and the San Rafael High Auditorium. 3. TIMES: School facilities and fields will be available to the City Rec- reation Dept. for scheduling after 3 p.m. during the week and after 8 a.m. on weekends, with the exception of Santa Venetia Middle School, which is available after 4 p.m. during the week. Exceptions to these times, when needed, will be arranged by the School District with the City Recreation Dept. Activities scheduled for these facilities are to conclude on or before 10 p.m. 4. USEAGE: Gymnasiums are not to be used by Dance Groups or for other acti- vities which might damage the floor surface. Facilities are to be left in a clean and orderly condition ready for use by the school for instru- ctional purposes the following day. 5. BUILDINGS AND GROUNDS SECURITY: During the time that school facilities and fields are scheduled or use by the San Rafael Recreation Dept., the Recreation Dept. is responsible for opening and securing facilities, in- cluding disengaging and re-engaging alarm systems. Keys will be provided to the Recreation Dept. by the School District. The School District will request that keys in the possession of non -School District personnel be recalled. The City will exercise close and careful control of keys limit- ing their use to responsible adults only. 6. MAINTENANCE AND CARE: Groups using the facilities or fields are expected to assist in the maintenance and upkeep of the property including replace- ment of equipment and/or accessories which they use and which wear out through normal use or with the passing of time. This expectation will be communicated to the users by the San Rafael Recreation Dept. 7. USER FEE GUIDELINES: As stipulated in the Agreement, the City may charge a user ee. Fees charged will be sufficient to cover administrative costs and the cost of custodial and grounds care so that after use, facilities and fields are left in an orderly and neat condition. Litter generated by users will be cleaned up following the activity or the user will be charge a fee to cover the costs of cleanup. The City will either provide the labor for cleanup of grounds or pay the cost of cleanup to the school district. All residents of the San Rafael Elementary and High School Districts must have equal access to the facilities and fields and any fees MAY Page 1. CO _ 7. USER FEE GUIDELINES (Continued): charged by the City for activities on school premises must be uniform for residents of the two districts. City is not responsible for debris left by unauthorized use. 8. STORAGE: Storage by groups using the facilities is not provided by the School District. 9. RESTROOMS: Portable restroom facilities will be required by the City where restroom facilities are not available for groups using fields and the group will be charged accordingly. 10. INFORMATION: A copy -.of all district facility or field use requests will e forwarded to the San Rafael City Schools Business Office. 11. REIMBURSEMENT: The City will reimburse the School District for utilities and all direct costs that originate from activities of Class 3 & 4 users scheduled by the City in School District facilities or on School District playing fields. Equipment used in conjunction with the facility, if damaged, will be repaired or replaced by the user. 12. SCHEDULE OF COSTS: A schedule of utility costs will be prepared by the School District for gymnasium facilities showing the actual hourly rate for use of each facility by Class 3 & 4 users. 13. BILLING PROCESS: The City of San Rafael will be billed by the School District at the end of January and again at the end of June for costs of facility and field useage. 14. AMOUNTS TO BE CHARGED TO USERS: Income received by the City from non- resident and/or commercial groups using school facilities is to be paid to the School District, less a suitable fee for administrative and staff costs incurred by the City. 15. PRIOR AGREEMENTS: Facilities or fields scheduled by the School District prior to adoption of this Memorandum will be honored for the period pre- viously approved. Renewals will be re -negotiated with the City.
