HomeMy WebLinkAboutResolution No. 5572RESOLUTION NO. 5572 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a contract, lease or agreement with N.Y.-CAL INDUSTRIAL CORP. RELATING TO PEACOCK GAP SUBDIVISION TO EXTEND TIME LIMITS FOR PROJECT PROCESSING PURSUANT TO GOVT. CODE SEC. 65957 a copy of which is hereby attached and by this reference made a part hereof. I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of said City held on Monday the twentieth day of November 1978 by the following vote, to wit: AYES: COUNCILMEN: Jensen, Mi.ski.men, Mulryan and Mayor Betti.ni. LEONCINI, City Clerk 1/78 -CC 11 FL Sl L MUTUAL AGREEMENT TO EXTEND TIME LIMITS FOR PROJECT PROCESSING PURSUANT TO GOVERNMENT CODE SECTION 65957 WITNESSETH: WHEREAS, the N.Y.-Cal Industrial Corp. (applicant herein) has submitted applications to the City of San Rafael (City herein) for processing of a development project, a sub- division in Peacock Gap (subdivision herein); and, WHEREAS, pursuant to Government Code Section 65950, the City "shall approve or disapprove such project within one year from the date Yon which an application requesting approval of such project has been received and accepted as complete by such agency"; and, WHEREAS, pursuant to Government Code Section 65957, the time limit referenced in Section 65950 "may be extended for a period not to exceed ninety days upon consent of the public agency and the applicant"; and, WHEREAS, both parties herein desire the maximum time available for processing of the subdivision; and, WHEREAS, in order to guarantee that the ninety -day time limit extension is granted automatically if, at the end of December 31, 1978, all permit approval or disapproval has not been rendered by the City; NOW, THEREFORE, BOTH PARTIES AGREE that if, at the end of December 31, 1978, all permit approval or disapproval has not been rendered by the City for the subdivision, the time limit shall automatically be extended ninety days, commencing January 1, 1979.
