RESOLUTION FINDING AND DETERMINING THAT THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE CONSTRUCTION
OF IMPROVEMENTS AND ACQUISITIONS IN SMITH RANCH
ASSESSMENT DISTRICT NO. 1, CITY OF SAN RAFAEL, MARIN
COUNTY, CALIFORNIA
WHEREAS, a public hearing, for which reasonable notice has
been given by publication, posting and mailing, has been held as to
the public convenience and necessity of the improvements and acquis-
itions in Smith Ranch Assessment District No. 1, City of San Rafael,
Marin County, California; and
WHEREAS, this Council has heard and considered all the evi-
dence, both oral and written, relative to the public convenience
and necessity of the construction of the aforesaid improvements;
NOW, THEREFORE, BE IT RESOLVED that this Council finds and
determines that the public convenience and necessity require the
improvements and acquisitions proposed to be acquired and improved
in Smith Ranch Assessment District No. 1, City of San Rafael, Marin
County, California, and further determines that the "Special Assess-
ment Investigation, Limitation and Majority Protest Act of 1931"
shall not apply to these assessment proceedings; and
BE IT FURTHER RESOLVED that this project shall proceed in
accordance with the terms and provisions of the Municipal Improvement
Act of 1913.
I HEREBY CERTIFY that the foregoing resolution was duly and
regularly adopted by the City Council of the City of San Rafael, Marin
County, California, at a regular meeting thereof, held on the 4th day
of October, 1976, by the following vote, to wit:
AYES: Councilmen ,Ipncan. Mulryan- Nixon and Mayor Bettini
NOES: Councilmen None
ABSENT: Councilmen Miskimen
