A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf
of the City of San Rafael a lease or agreement with
San Rafael Chamber of Commerce (Christmas Decorations)
A copy of which is hereby attached and by this reference made a part
hereof.
I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a
regular meeting of the City Council of said
City held on Monday the 4th _ day of October
19 76 , by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Mulryan, Nixon and Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Miskimen

AGREEMENT
THIS AGREEMENT is made and entered into by and between the
CITY OF SAN RAFAEL, hereinafter referred to as "CITY", and the
SAN RAFAEL CHAMBER OF COMMERCE, a corporation, hereinafter referred to
as "CHAMBER", both of whom understand as follows:
R E C I T A L S
WHEREAS, Chamber is undertaking to provide outdoor Christmas
Decorations along Fourth Street, San Rafael, California, to engender
the spirit of the Holiday Season thereby promoting business activity
among the merchants located along said Fourth Street; and
WHEREAS, Chamber is seeking financial support to help defray
the cost of said Christmas Decorations;
THEREFORE, City and Chamber, in consideration of these mutual
promises to each other, hereinafter stated, agree as follows:
1. City shall pay to Chamber the sum of One Thousand Dollars
($1,000.00) payable on or before December 20, 1976 to be used to help
defray the cost of said Christmas Decorations.
2. Chamber, in return promises as follows:
(a) To plan, coordinate, and finance a Christmas
Decorations program.
(b) To install, or contract for installation of said
Decorations; installation to be completed no later than December 10,
1976.
(c) To insure that all decorations are so designed and
constructed out of materials capable of withstanding the rigors of
winter weather common to San Rafael.
(d) To insure that all decorations be so rendered as to
be acceptable to community standards of esthetics and beauty generally
applied to such decorations.
(e) To insure that all said Decorations shall, be taken
down and removed from Fourth Street within a reasonable time following
the Christmas and New Year Holidays, but no later than January 5, 1977.
This instrument embodies the whole agreement of the parties.
There are no promises, terms, conditions, or obligations other than
those contained herein; and this Agreement shall supercede all previous
communications, representations, or agreements, either verbal or written,
between the parties hereto.
The City of San Rafael hereby expressly denies any and all
liability in excess of the One Thousand Dollars ($1,000.00) referred
to in Section 1., above.
