RESOLUTION DECLARING SURPLUS IN IMPROVEMENT FUND,
EAST SAN RAFAEL ASSESSMENT DISTRICT NO. 2, CITY OF
SAN RAFAEL, MARIN COUNT, CALIFORNIA
WHEREAS, on the 20th day of January, 1964, the City Council of
the City of San Rafael, Marin County, California, adopted its final
Resolution of Intention for public improvements in East San Rafael
Assessment District No. 2, City of San Rafael, Marin County, California,
and therein provided that any surplus in the improvement fund for said
assessment district, after completion of improvements and payment of
all claims from the improvement fund, would be applied as a credit to
each assessment in accordance with the provisions of the Municipal
Improvement Act of 1913; and
WHEREAS, on the 19th day of May, 1975, said City Council of the
City of San Rafael by Resolution No. 4963 amended the final Resolution
of Intention in the matter of the distribution of surplus and provided
that any surplus funds shall be used for the maintenance of the improve-
ments, in accordance with the provisions of Section 10427(c) of the
Streets and Highways Code of the State of California; and
WHEREAS, said improvements have been completed and all claims
upon the improvement fund have been paid,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
San Rafael, Marin County, California, as follows:
1. That the City Council of the City of San Rafael hereby finds
that a balance of $47,407.50 remains in the improvement fund for East
San Rafael Assessment District No. 2, City of San Rafael, Marin County,
California, and hereby determines that said amount is surplus.
2. That the surplus shall be set aside in a special fund to be
designated "Maintenance Fund, East San Rafael Assessment District No. 2,

City of San Rafael, Marin County, California," and shall be used
for the maintenance of the improvements constructed and acquired in
East San Rafael Assessment District No. 2, City of San Rafael,Marin
County, California, until said special fund is exhausted.
I HEREBY CERTIFY that the foregoing Resolution was duly and
regularly adopted by the City Council of the City of San Rafael,
Marin County, California, at a regular meeting thereof held on the
6th day of December, 1976, by the following vote, to wit:
AYES: Councilmen: Jensen, Miskimen, Mulr_yan, Nixon and Mayor Bettini
NOES: Councilmen: Pone
