A RESOLUTION AUTHORIZING THE ACCEPTANCE
OF A GRANT DEED
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as
follows:
The MAYOR and CITY CLERK are authorized to accept,
on behalf of the City of San Rafael, a Grant Deed to
accept property from the Marin County Open Space District ,
a copy of which is hereby attached and by this reference made a
part hereof.
I, MARION A. GRADY, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City held on Monday the 6th day of December, 1976, by the following
vote, to -wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon, and Mayor Bettini
NOES: COUNCILMEN: None

THE CI'TY OF SAN RAFAEL, a municipal corporation,
GRANTS TO
THE MARIN COUNTY OPEN SPACE DISTRICT, a public body, corporate and politic, the real
property in the City of San Rafael, County of Marin, State of California, described as follows
Beginning at the southeasterly corner of that lot of land conveyed
by JAMES D. BULLIS to G. S. HASKELL, by deed dated July 9, 1866, and
recorded on page 113 of Liber F of Deeds, in the office of the County Recorder
of said Marin County, said point of beginning being 238-1/2 feet measured
northerly along the easterly line of E Street from the northerly side o; Fifth
Avenue, and running thence, by the true meridian on a course parallel to -the
northerly side of Fifth Avenue, S 83 degrees 45' E 319-1/2 feet to a post marked
W. 2 x S; thence N 23 degrees 3' E 246-1/4 feet to a post marked W. 3 x S
driven in the clump of live oak brushes; thence N 38 degrees W 115-1/2 feet
to a post marked W. 4 x S, from which a live oak tree 2 feet in diameter marked
B.T.W. 4 bears S 23 degrees W, distant 9-1/4 feet; thence N 6-1/4 degrees E,
330 feet (at 130 feet this latter course passes 2 feet west of water tank) , to
the northeast corner of that lot of land conveyed to SYDNEY V. SMITH to JAMES
D. WALKER by deed dated July 1, 1869, and recorded on page 502 of Liber G
of Deeds, Marin County Records; thence by the true meridian, and ascending
to 'the southerly slope of San Rafael Hill, N 36 degrees 15' E 792 feet to a
stake in a stone mound, said point being the True Point Of Beginning;
Thence N 53 degrees 45'W, 162.08'; thence S 36 degrees 15' W,
268.76'; thence S 53 degrees 45' E, 162.08'; Thence N 36 degrees 15' E,
268.76', returning to the "True Point of Beginning" - said parcel being rec-
tangular and containing one (1) acre +.

conveyed herein, shall remain permanently for the public enjoyment and use as
open space.
"This CONDITION shall run with the land in perpetuity and shall bind Grantee,
its successors and assigns.
"Upon breach of, or Grantee's failure to comply with said CONDITION, an immediate
forfeiture shall occur and title shall revert to Grantor. "
