A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf
of the City of San Rafael a lease or agreement with
San Rafael Sanitation District
(Pistol Range)
A copy of which is hereby attached and by this reference made a part
hereof.
I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the City Council of said
City held on Monday the

PISTOL RANGE LEASE AGREEMENT
This Agreement, made and entered into this 2nd day of Harch
1977, by and between the San Rafael Sanitation District of Marin County,
California, hereinafter referred to as the "Lessor" and the City of San Rafael,
County of Marin and the Tamalpais Revolver Club (a non-profit corporation)
hereinafter referred to as "Lessees".
W I T N E S S E T H:
WHEREAS, the Lessor is the owner of that certain property generally
known as the Pistol Range, a part of A. P. 9-010-30, and which is further
described on the attached map labeled Exhibit "A"; and,
WHEREAS, said property has been previously leased by Lessor to the
County of Marin and to the City of San Rafael for use as a target range for the
training of peace officers; and,
WHEREAS, the Tamalpais Revolver Club desires to use such property on
Sundays and the County of Marin/City of San Rafael have no objection to use of
said property on Sundays by the Tamalpais Revolver Club.
NOW, THEREFORE, it is mutually agreed by and between the parties
hereto as follows:
1. The San Rafael Sanitation District of Marin County does hereby
lease and demise and let unto the County of Marin, the City of San Rafael and
the Tamalpais Revolver Club all that certain property described above and on
Exhibit "A" for the use as a Pistol Range, to have and to hold said premises
for a term commencing on the date of this agreement and continuing thereafter
on a month-to-month basis.

2. The County of Marin, the City of San Rafael and the Tamalpais
Revolver Club agree to pay a sum of $1.00 per month to be paid on a yearly
basis in December.
3. This month-to-month rental may be terminated by any of the
parties hereto by giving a minimum of ninety days written notice.
4. The County of Marin, the City of San Rafael and the Tamalpais
Revolver Club shall indemnify and hold harmless the San Rafael Sanitation
District from any liability for personal injury or property damage arising
from the use of said premises by the County of Marin, the City of San Rafael
and the Tamalpais Revolver Club. The County of Marin and the City of San Rafael
shall obtain public umbrella liability insurance in the amount of five million
dollars without a deductible clause, naming the Lessor as the additional insured.
A certificate of insurance attesting to this fact shall be provided to Lessor
at the time the agreement is signed.
5. The Tamalpais Revolver Club shall obtain public umbrella liability
insurance in the amount of one million dollars without a deductible clause,
naming the Lessor as the additional insured. A certificate of insurance attesting
to this fact shall be provided to Lessor at the time the agreement is signed.
6. Nothing in this lease small prevent the Lessor from using said
real property in a manner which is consistent with the operation of the Pistol
Range by the County of Marin, the City of San Rafael and the Tamalpais Revolver
Club.
7. The County of Marin shall serve as lead agency for the three
Lessees to coordinate insurance requirements, etc.

8. This agreement shall be automatically renewed as to each of
the parties unless notice of termination, as defined in Paragraph 3, is made
by one of the parties, in which case termination will be effective only as
to the parties seeking termination.
