A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf
of the City of San Rafael a lease or agreement with
COUNTY OF MARIN for Loan of One (1) Heavy Duty S rPat Fliicha�Tr
A copy of which is hereby attached and by this reference made a part
hereof.
I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the City Council of said
City held on Monday the 7th _ day of Marsh

AGREEMENT
This Agreement made and entered into this 10th day of March
1977, by and between Marin County (hereinafter referred to as "County") and
City of Ban Rafael
(hereinafter referred to as
City ) provides as follows:
1. The following equipment which has been loaned to the County by
City/County of San Francisco will be provided to City of Ban Rafael
for emergency use:
One (1) heavy duty, street flusher truck, identification viz:

This truck has the following characteristics:
a. Five hundred (500) cubic inch displacement engine (approximately);
b. Six (6) 1100 x 22 twelve (12) -ply tires;
c. Full air brakes;
d. Twenty-five hundred (2,500) -gallon capacity mounted water tank;
e. Independent, six (6)-cyltndex pump engine (approximately two
,
hundred twenty (220) cubic inches) for single stage, seven hundred fifty (750)
gallons--per-minute capacity centrifugal pump rated for maximum pressure of
one hundred twenty-five (125) pounds; and
f. Pump connected and bolted to engine bell housing.
2. The loan from the City/County of San Francisco is for only 90
days commencing March 10, 1977, and the equipment must be returned not later
than June 10, 1977, unless said period is extended by mutual agreement,
3. The City of San Rafael shall return the equipment to the
point of origin in as good condition as when loaned, except for reasonable
wear. City of San Rafael is totally responsible for the cost of
handling, care, protection, operation, maintenance, and repair or replacement
of the equipment. If the equipment is lost, damaged or destroyed, City
will repair, recondition or replace such property to the condition when loaned,
or reimburse County for the cost thereof, as determined by the City/County of
San Francisco. If after reasonable demand the City fails to
do so, County shall have the option to repair or replace the equipment, or
reimburse the City/County of San Francisco for its cost. In such case,
. CITY shall be liable to County for all costs and expenses
incurred by County.
4. City hereby waives all rights to recover
damages from County for injury to persons or property arising out of the
loan, transportation, possession or use of the equipment, and shall hold
County harmless for.all claims by third parties for injury to person or
property attributable to the use of the equipment.
5. This Agreement can be terminated at any time upon rendition
of 10 days written notice. In such case, the equipment shall be returned
to the point of origin immediately, at City0a sole expense.
