HomeMy WebLinkAboutResolution No. 5267RESOLUTION NO.5267 RESOLUTION OF THE COUNCIL OF THE CITY OF SAN RAFAEL DECLARING CANVASS OF RETURNS AND RESULTS OF GENERAL MUNICIPAL ELECTION HELD ON MARCH 8, 1977 WHEREAS, in pursuance of law and the Charter of the City of San Rafael, there was held in said City and in San Rafael School District and in San Rafael High School District on Tuesday, the 8th day of March, 1977, a general municipal election to elect municipal officers and members of the Board of Education, at which election the offices to be filled and the candidates for such offices were as follows: FOR COUNCILMEN: (Two to be elected for full term of four years each) CLIFFORD P. ELBING JACK G. NIXON LAWRENCE E. MULRYAN FRED C. ROBBINS, JR. FOR MEMBERS OF BOARD OF EDUCATION: (Two to be elected for full term SUZANNE L. BEITTEL of four years each) RICHARD A. BLANK, JR. PAUL K. McMULLEN WHEREAS, at said election the following measures, and each of them, were submitted to the electors of the City: CITY ATTORNEY MEASURE F: Shall Section 1 and Section 11 of Article VI of the Charter of the City of San Rafael be amended effective at 12:00 midnight the day prior to the next general municipal election in 1979, so as to make the office of City Attorney appointive rather than elective? The text of said amendment is set forth in Section B of Resolution No. 5239, passed by the City Council of San Rafael on Monday, the 3rd day of January 1977, and is now on file in the office of the City Clerk. CITY TAX AND LICENSE COLLECTOR MEASURE G: Shall Section 1 and Section 11 of Article VI of the Charter of the City of San Rafael be amended effective at 12:00 midnight the day prior to the next general municipal election in 1979, so as to make the office of City Tax and License Collector appointive rather than elective? The text of said amendment is set forth in Section A of Resolution No. 5239, passed by the City Council of the City of San Rafael on Monday, the 3rd day of January 1977, and is now on file in the office of the City Clerk. LOW COST HOUSING ELECTION MEASURE H: Should the City of San Rafael or any other public agencies be authorized to assist in the development, construction and/or acquisition of not more than 120 units of privately sponsored senior citizen rental housing in downtown San Rafael for low and moderate income persons through the use of federal, state or local public financing and/or private financing? WHEREAS, said general municipal election was held on Tuesday, March 8, 1977, in accordance with law and the votes thereat received and canvassed, and the returns thereof ascertained, determined and declared in all respects as required by law; as follows: NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Rafael, 1. That the City Clerk of the City of San Rafael be, and is hereby, instructed to enter this resolution on the minutes of the Council as a statement of the results of said election. 2. That the whole number of votes cast at said election was 8,941 votes. (a) That the total number of votes cast for municipal offices and measures at said election in said City was 6,685 (b) That the total number of votes cast outside the city limits of said City in said School Districts was 2,256 3. That the names of the persons voted for and the respective offices to be filled, for which ballots were cast, and the number of votes given in each precinct and by absentee voters to each of said persons was as detailed in Exhibit A, attached. 4. That at said general municipal election the following named persons received the largest number of votes for the following offices, respectively, and were, therefore, duly elected to the respective office for which they were respectively candidates, and each of said persons having received the largest number of votes cast for any person for such office is hereby declared to be duly and regularly elected to such office, respectively for the term commencing March 15, 1977, and the City Clerk is hereby directed to issue a Certificate of Election to each of said persons, certi- fying his election to the office appearing after his name, and to administer to each of said persons the oath of office prescribed by the Constitution and laws of the State of California and the Charter of said City, to wit: -2- LAWRENCE E. MULRYAN COUNCILMAN JACK G. NIXON COUNCILMAN SUZANNE L. BEITTEL MEMBER OF BOARD OF EDUCATION PAUL K. McMULLEN MEMBER OF BOARD OF EDUCATION 5. That less than a majority of all the votes cast on said Measure F were in favor of said Measure, and said Measure failed to carry. 6. That less than a majority of all the votes cast on said Measure G were in favor of said Measure, and said Measure failed to carry. 7. That more than a majority of all the votes cast on said Measure H were in favor of said Measure, and said Measure carried. 8. That all absentee voters' ballots have been duly received and canvassed in time, form and manner as required by law. I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a special meeting of the Council of said City held on Tuesday, the fifteenth day of March, 1977, by the following vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None MARION A.
