A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf
of the City of San Rafael a lease or agreement with
County of Marin and County Service Area No 19 amending AgreemenlAsited
February 17, 1977 to raise amount of contribution for fire station.__
A copy of which is hereby attached and by this reference made a part
hereof.
I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the City Council of said
City held on Monday the 7th _ day of March
19 77 , by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Mulryan, Nixon and Mayor Bettini

AMENDMENT TO AGREEMENT
THIS AMENDMENT TO AGREEMENT made and entered into this
day of March, 1977 by and between THE CITY OF SAN RAFAEL,
Hereinafter referred to as "City", THE COUNTY OF MARIN, hereinafter
referred to as "County",and COUNTY SERVICE AREA NO. 19 of the County
of Marin, hereinafter referred to as"Service Area";
W I T N E S S E T H:
WHEREAS, the parties hereto have heretofore entered
into an agreement dated February 17, 1976, and
WHEREAS, unforeseen price increases and delays in
construction have caused escalation in the total co$t of fire
station construction; and
WHEREAS, it is the mutual desire of the parties hereto
to amend said agreement with respect to the contribution required;
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL PROMISES
AND COVENANTS HEREINAFTER CONTAINED, the parties hereto agree as follows:
1. Paragraph C-1 on Page 2 of the aforesaid agreement
is amended to read:
"Service area agrees to contribute to the
construction of the'fire station defined in
A-1 above in the amount of one-half of the
total cost of design, construction, site
development and other cost directly related
to said fire station construction, up to an
amount not to exceed $85,000; this amount to
be exclusive of the revenue proceeds from
the 71¢ tax rate referred to in paragraph C-2
below; payment of the funds for construction
to be made to the City based on a prorating of
progress payments by the City for costs pf
said construction."
2. In all other respects the aforesaid agreement dated
February 17, 1976 shall remain in full force and effect.
IN WITNESS WHEREOF the parties hereto have set their
band the date and year first above written.
