RESOLUTION N0. 5271
A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf
of the City of San Rafael a lease or agreement with
TRINITY COMMUNITY CHURCH re CONDUCTING OF EASTER SUNRISE SERVICES ON
SAN RAFAEL HILL
A copy of which is hereby attached and by this reference made a part
hereof.
I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the City Council of said
City held on Monday —the -21st _day of March
19 77 , by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Nixon and Acting Mayor Mulryan
NOES: COUNCILMEN: None

AGREEMENT
THIS AGREEMENT entered into on this 21st day of March
1977, between the CITY OF SAN RAFAEL (hereinafter called "CITY") and the
TRINITY COMMUNITY CHURCH (hereinafter called "CHURCH");
WHEREAS, to accommodate the Church and citizens desiring to
attend Easter services on San Rafael Hill, the City agrees to permit
the Church to conduct Easter sunrise services on San Rafael Hill. In
consideration of City permitting the Church to utilize their property
for these religious purposes, Church agrees to hold the City harmless
for any liability which may occur as a result of the religious services
being conducted on the City's property on Easter Day, April 10,,1977;
WHEREAS, the Church agrees to indemnify the City and their
respective legal representatives from and against all demands, claims,
action, losses and expenses arising therefrom.
Prior to execution of this Agreement by the City, Church must
furnish evidence in the form of a Certificate of Insurance of Church
for Comprehensive General Liability in the amount of $100,000.00 for
injury to each person, $300,000.00 for each occurrence, and $2,000,000.00
of Comprehensive Excess Indemnity. For the purpose of this Agreement,
a Certificate of Insurance reflecting that the City is carried as an
additional insured for the purposes of the Easter Day ceremonies on
April 10, 1977 would be satisfactory.
IN WITNESS WHEREOF the Parties have signed this Agreement.
