RESOLUTION AMENDING RESOLUTION OF INTENTION IN
THE MATTER OF THE WORK TO BE DONE, COSTS THEREOF,
AND CONTRACT WITH SAN RAFAEL SANITATION DISTRICT
IN BAHIA DE RAFAEL INDUSTRIAL PARI: ASSESSMENT
DISTRICT, CITY OF SAN RAFAEL, MARIN COUNTY,
CALIFORNIA
BE IT RESOLVED by the City Council of the City of San
Rafael, Marin County, California, that Resolution of Intention
No. 4248, adopted by the City Council of the City of San Rafael
on the 19th day of June, 1972, and amended by Resolution No. 4338
and Resolution No. 5101 subsequent thereto, be amended as follows:

1. By adding to the description of the work contained
therein, the following language:
"The installation of one or more control projects
to eliminate, reduce, shield and otherwise control
odors emanating from the main treatment plant of
the San Rafael Sanitation District."
2. By adding to the paragraph describing the contract
entered into between the City of San Rafael and the San Rafael
Sanitation District conveying a system of sanitation facilities,
the following language:
"... ; said system of sanitation facilities to
include one or more control projects to eliminate,
reduce, shield and otherwise control odors emanat-
ing from the main treatment plant of the San Rafael
Sanitation District."
BE IT FURTHER RESOLVED that it is the finding of said City
Council that the cost of said proposed additional work is Sixty
Thousand Dollars ($60,000.00), which sum shall be paid to the San
Rafael Sanitation District pursuant to an amendment of the contract
between the City of San Rafael and the San Rafael Sanitation District.

BE IT FURTHER RESOLVED that it is the finding of said
City Council that these changes are being made in accordance
with the provisions of Section 10352 of the Streets and Highways
Code of the State of California; that the improvement fund of the
Bahia De Rafael Industrial Park Assessment District contains
sufficient funds for the required payment, and that the cost of
said work will not increase the total amount of the assessment nor
will it increase the assessment of any individual parcel of property
in said assessment district, and that the properties benefited by
the expenditure of the said $60,000.00 are those properties located
within the boundaries of the Bahia De Rafael Industrial Park Assess-
ment District.
I HEREBY CERTIFY that the foregoing resolution was duly
and regularly adopted by the City Council of the City of San Rafael,
Marin County, California, at a regular meeting thereof, held on the
21st day of March, 1977, by the following vote, to wit:
AYES: Councilmen• Miskimen, Nixon and Acting Mayor Mulryan
NOES: Councilmen: None
ABSENT: Councilmen Jensen and Mayor Bettini
