RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT
TO AGREEMENT BETWEEN SAN RAFAEL SANITATION
DISTRICT AND THE CITY OF SAN RAFAEL IN
CONNECTION WITH BAHIA DE RAFAEL INDUSTRIAL
PARK ASSESSMENT DISTRICT, CITY OF SAN RAFAEL,
MARIN COUNTY, CALIFORNIA
BE IT RESOLVED by the City Council of the City of
San Rafael, Marin County, California, that the Mayor of the
City of San Rafael be authorized to sign, and the City Clerk
be authorized to attest, that certain amendment to agreement
between the City of San Rafael and the San Rafael Sanitation
District, which said amendment is attached hereto.
BE IT FURTHER RESOLVED that a copy of said amendment
is to be filed with the original agreement on file in the office
of the City Clerk of the City of San Rafael, Marin County,
California.
I HEREBY CERTIFY that the foregoing resolution was duly
and regularly adopted by the City Council of the City of San
Rafael, Marin County, California, at a regular meeting thereof,
held on the 21st day of March, 1977., by the following vote, to wit:
AYES: Councilmen: Miskimen, Nixon and Acting Mayor Mulryan

AMENDMENT TO AGREEMENT
TIIIS AMENDMENT TO AGREEMENT, made and entered into this
21st day of March, 1977, by and between the SAN RAFAEL SANITATION
DISTRICT, hereinafter referred to as "District," and the CITY OF
SAN RAFAEL, a municipal corporation of the State of California,
hereinafter referred to as "City;"
W I T N E S S E T H:
1. District and City entered into an agreement dated
the 5th day of February , 1973 , under the terms of which
City agreed to construct and convey to District, a system of
sewage collection facilities in the Bahia De Rafael Industrial
Park Assessment District, City of San Rafael, Marin County,
California.
2. It has been determined between the parties hereto
in connection with said system of sewage collection facilities
that the public interest and convenience require the construction
by District of one or more control projects at the sewage treatment
plant, the purpose of which will be to eliminate, reduce, shield
and otherwise control odors emanating from the main treatment
plant of District.
3. That the sum of Sixty Thousand Dollars ($60,000.00)
shall be paid by City to District for the cost of said odor control
construction projects and that said sum shall be paid from the
improvement fund of Bahia De Rafael Industrial Park Assessment
District.
4. That upon completion of the odor control project work
by District, said improvements shall become the property of
District and shall be under the management and control of District.
