HomeMy WebLinkAboutCC Resolution 5282 (Sanitary Sewer Reconstruction)RESOLUTION NO. 5282 RESOLUTION OF AWARD OF CONTRACT WHEREAS, on the 1ST day of APRIL, 1977, pursuant to due and legal notice published in the manner provided by law, inviting sealed bids or proposals for the work hereinto mentioned, as more fully appears from the Affidavit of Publication thereof on file in the office of the City Clerk of the City of San Rafael, California, the City Clerk of said City did publicly open, examine, and declare all sealed bids or proposals for doing the following work in said City, to wit: SANITARY SEWER RECONSTRUCTION EDA/LPW PROJECT NO. 07-51-02888 in accordance with the plans and specifications therefor on file in the office of said City Clerk; and WHEREAS, the bid of RAY N. BERTELSEN CO., INC. AND RAY N. BERTELSEN CO., A JOINT VENTURE at the UNIT prices stated in its bid, less Phases E, F, and G, was and is the lowest and best bid for said work and said bidder is the lowest responsible bidder therefor; NOW, THEREFORE, IT IS HEREBY ORDERED AND RESOLVED that the bid of RAY N. BERTELSEN CO., INC. AND RAY N. BERTELSEN CO., A JOINT VENTURE be and the same is hereby accepted at said UNIT prices, less Phases E, F, and G, and that the contract for said work and improve- ments be and the same is hereby awarded to said RAY N. BERTELSEN CO., INC. AND RAY N. BERTELSEN CO., A JOINT VENTURE AT THE UNIT prices, less Phases E, F, and G, mentioned in said bid, subject to approval and project funding by the U. S. Department of Commerce, Economic Development Administration, Grantor of the project funds. By accept- ing and awarding the contract at this time, the City of San Rafael assumes no responsibility for any subsequent actions by RAY N. BERTELSEN CO., INC. AND RAY N. BERTELSEN CO., A JOINT VENTURE, should the U. S. Department of Commerce, Economic Development Administration not concur in this award. Furthermore, the project may be terminated at such time the U. S. Department of Commerce, Economic Development Administration should withdraw project funding. ORIGINAL -' IT IS FURTHER ORDERED AND RESOLVED that any and all certified checks, cash, or bond accompanying the bids of unsuccess- ful bidders be forthwith returned to them respectively; IT IS FURTHER ORDERED AND RESOLVED that the City Engineer is hereby authorized to extend the time for completion of the con- tract as set forth herein upon showing of good cause by the Con- tractor; IT IS FURTHER ORDERED AND RESOLVED that the Mayor and the City Clerk of said City be authorized to execute a contract with RAY N. BERTELSEN CO., INC. AND RAY N. BERTELSEN CO., A JOINT VENTURE for said work and to return the bidder's bond upon the execution of said contract. I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a REGULAR meeting of the Council of said City on MONDAY, the 4TH day of APRIL, 1977, by the following vote, to wit: AYES: COUNCILMEN Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini NOES: COUNCILMEN None ABSENT: COUNCILMEN None - 2 - MARION A.
