HomeMy WebLinkAboutResolution No. 5283RESOLUTION NO. 5283 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL TERMINATING AGREEMENT WITH THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND INTENT TO ENTER INTO A CONTRACT IN THE MARIN COUNTY EMPLOYEES' RETIREMENT ASSOCIATION WHEREAS, the City of San Rafael entered into an agreement with the Board of Administration of the California Public Employees' Retirement System, pursuant to Sections 20450 - 20532, Government Code, for the participation of employees of the City as members of the Public Employees Retirement System effective July 1, 1957; and WHEREAS, Section 20569 of the Government Code provides that participation of the contracting agency in the Public Employees' Retirement System may be terminated if the Board of Administration, Public Employees' Retirement System, the Governing Body of the con- tracting agency, and the Board of Supervisors of a County maintaining a retirement system under the County Employees Retirement Law of 1937 enter into an agreement for such termination and inclusion of the con- tracting agency employees into the Marin County Employees' Retirement Association; and WHEREAS, the City has met and conferred with the employees' representatives and both the City and the employees desire to terminate their contract between the California Public Employees' Retirement System and further desire admission to the Marin County Employees' Retirement Association; and WHEREAS, it is the City Council's intent to terminate the contract between the City of San Rafaeland the Board of Administration, California Public Employees' Retirement System; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: That the Mayor and City Clerk of San Rafael are authorized to sign the attached Contract terminating membership in the Public Employees' Retirement System on the 30th day of June, 1977, and commencing with the Marin County Employees' Retirement Association effective July 1, 1977. I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify that the foregoing Resolution was duly and regularly intro- duced and adopted at a regular meeting of the Council of said City held on Monday the 4th day of April 1977, by the following vote, to -wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None ��J�L�ti --- �• , � � pct MARION A.
