RESOLUTION NO. 5293
AUTHORIZING THE SIGNING OF A LEASE AGREEMENT - PARKING LOT
WHEREAS, it is the objective of the City of San Rafael to
provide off-street public parking at a minimum cost to the City;
and
WHEREAS, the San Rafael Redevelopment Agency is offering
a parking lot to the City to be used for public parking as per
Lease Agreement referenced as "Exhibit A" attached hereto and
forming a part hereof as though fully set forth herewith.
HEREBY:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
RESOLVES, that the Mayor and City Clerk are authorized and
directed to execute, on behalf of the City of San Rafael a Lease
Agreement hereinabove referenced as "Exhibit A".
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a regular meeting of the City Council of said
City held on Monday , the 2nd day of May
19 77, by the following vote, to -wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mullryan and Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Nixon

This Agreement of Lease, made this day of
1977, by and between the San Rafael
Redevelopment Agency of 1313 Fifth Avenue, San Rafael, California,
hereinafter called Lessor, and the City of San Rafael of 1400 Fifth
Avenue, San Rafael, California, hereinafter called Lessee.
Witnesseth, that Lessor does hereby lease and demise
unto Lessee the following real property:
The parking lot on Third Street opposite Lindaro Street,
San Rafael (A. P. #11-271-12 & 13) for the term of one (1) year
beginning January 1, 1977, and ending December 31, 1977, for
the purpose of conducting thereon a public parking lot, Lessor reserving,
and Lessee yielding and paying unto Lessor without demand therefor
being made, annual rent as follows:
The sum of One Dollar ($1.00) .
Renewal. It is agreed that unless Lessor gives Lessee,
or Lessee gives Lessor, written notice of an intention to terminate
this lease at least thirty (30) days before the and of the original
term or any renewal term of this lease, this lease shall renew itself
from year to year, until terminated by such notice, at the same
rental rate as hereinabove set forth.
It is hereby mutually understood and agreed that in consideration
of rent paid and Lessee maintaing parking meters on subject property the
Lessor hereby waives any and all present and future interest in revenues
deposited in said parking meters .
In Witness Whereof, the parties hereto have duly signed
and sealed this agreement the day and year first above written.
