RESOLUTION ORDERING. DETACHMENT OF TERRITORY DESIGNATED AS THE
" PAGANINI POINT"
REORGANIZATION FROM COUNTY SERVICE AREA NO. 19 OF THE COUNTY OF
MARIN TO THE CITY OF SAN RAFAEL
WHEREAS, the City Council of the City of San Rafael has here-
tofore adopted Resolution No. 5279 initiating proceedings for the detachment
of territory designated as the "Paganini Point" Reorganization from County
Service Area No. 19; and
WHEREAS, said proceedings were initiated pursuant to and to
accordance with the District Reorganization Act of 1965, Division 1, (commencing
with Section 56000 of Title 6) of the Government Code; and
WHEREAS, a hearing on said detachment was held and duly
noticed as required by law; and
WHEREAS, opponents of said annexation were given an oppor-
tunity to protest said detachment; and
WHEREAS, the City Council has reviewed Resolution No. 77-22 of
the Local Agency Formations Commission approving said detachment; and
WHEREAS, the City Council has received no majority protest
within the meaning of Section 56126 of the Government Code;
NOW, THEREFORE, BE IT RESOLVED that the detachment of that
certain territory known as the "Paganini Point" .reorganization, described in
Exhibit "A" from County Service Area No. 19 to the City of San Rafael Is hereby
approved;
BE IT FURTHER RESOLVED that said detachment shall not be
subject to any terms and conditions.
BE IT FURTHER RESOLVED that said detachment shall not be
subject to election pursuant to Section 56320 of the Government Code, inas-
much as the territory proposed to be detached is inhabited and the district is
a resident -voter district;
BE IT FURTHER RESOLVED that the Executive Director of
the Local Agency Formations Commission be and is hereby ordered to file
copies of this Resolution with those agencies required by law.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and
adopted at a regular meeting of the City Council of said City held on
Tuesday , the fifth day of July , 1977, by the
following vote, to -wit:

NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Nixon
