HomeMy WebLinkAboutResolution No. 5330RESOLUTION NO. 5330 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL CONCERNING MAINTENANCE OF THE PROPOSED SHORELINE PARK ASSOCIATED WITH THE SPINNAKER POINT DEVELOPMENT. WHEREAS, as a condition of approval of the Spinnaker Point Planned Development, the City of San Rafael has required the dedication, for public use and ownership, of lands totaling 45 acres, more or less, lying northerly and adjacent to said Planned Development; and WHEREAS, a dike maintenance easement over the existing dike lying within said 45 -acre parcel was conveyed to the City of San Rafael and recorded in O.R. 1935-11 on April 28, 1976; and WHEREAS, owner of said lands has agreed to convey to the City an easement for park purposes over that portion of the dike maintenance easement lying adjacent to and northerly of Spinnaker Point Unit No. One; and WHEREAS, the developer of said Spinnaker Point Planned De- velopment has agreed to install, on and within the area comprising said park easement, improvements consisting of planting of trees, shrubs, and ground cover, a drip -emitter irrigation system, benches, trash containers, and an all-weather surfaced pathway; NOW, THEREFORE, BE IT RESOLVED by the San Rafael City Council that the City of San Rafael agrees to maintain what is finally approved by the City as a shoreline park. I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of said City held onTuesday,the 5th day of July 1977, by the following vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: Nixon MARION A.
