HomeMy WebLinkAboutResolution No. 5339RESOLUTION NO. 5339 RESOLUTION OF INTENTION TO ORDER VACATION OF ALICE STREET, SAN RAFAEL, CALIFORNIA WHEREAS, it appears that Alice Street hereinafter described is unnecessary for present or prospective public purposes; NOW, THEREFORE, BE IT RESOLVED as follows: 1. That the City Council of the City of San Rafael hereby elects to proceed under the provisions of the STREET VACATION ACT of 1941 of the State of California; 2. That the City Council of the City of San Rafael hereby declares its intention to vacate Alice Street which is hereinafter described; 3. That Tuesday the 6TH day of SEPTEMBER, 1977, at eight o'clock p.m., in the Council Chambers at the City Hall, in the City of San Rafael, State of California, is hereby fixed as the time and place for hearing all persons interested in or objecting to the said proposed vacation. 4. That the Department of Public Works of the City of San Rafael shall post conspicuously notices of street vacation along the lines of said public street proposed to be vacated, which notices shall be posted not more than three hundred feet apart but at least three notices shall be posted as to said street proposed to be vacated. The said notice shall state time and place of hearing as hereinabove provided, and the adoption of the within resolution of intention. 5. That said street proposed to be vacated is described on Exhibit "A", which is attached hereto and incor- porated herein by this reference, as though set forth in full. - 1 - ORIGE l�TAL X339 6. That a map or plan showing said street proposed to be vacated is on file in the office of the City Clerk of the City of San Rafael, at the City Hall, San Rafael, California. I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a REGULAR meeting of the Council of said City held on MONDAY, the 1ST day of AUGUST, 1977, by the following vote, to -wit: AYES: COUNCILMEN Jensen, Miskimen, Mulryan and Mayor Bettini NOES: COUNCILMEN None ABSENT: COUNCILMEN Nixon 2 - dIEAAMNE�M.ALEONCINI, City Clerk BEGINNING -at the Northeasterly corner of that cert -a -n parcel of land as described in the Deed fA 'From ntonette Ferrario to MarJaret Cart-wright recorded January 31, 1949 in Book 607 of Officia= Records at page 2:0. Marin County Records, said point of beginning being also on the Southerly line of Mission Avenue, thence along the 'Easterly lane of said Cart- r wright parcel, South 15° 34' West 113.9 feet to the Southeasterly corner thereof; thence Southeasterly in a straight 1 ine 9 140.0 feet, more or less, to the Most Southwesterly corner of that certain pa_-rcel of land as described in the Deed from San Rafael Development Company, a corporation,Mar -ch to C. A. Bassart, recorded Mach 1S, "10,20 in Book 211 of Deeds at page 483, Marin County Recordse thence along the Westerly line of said Bassart parcel and its direct extension, %Torthsrly, a eis-ance of 111.7 feet to the Southerly line of Mission Avenue; and thence West-, erly along said Southerly line 20.0 feet, more or =ess, to the moi_ of beginning. - EXHIBIT A
