A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as
follows:
The MAYOR and CITY CLERK are authorized to execute, on
behalf of the City of San Rafael a lease or agreement with
County of Marin for two years'funding for Pickleweed Park
under the Local Park & Recreation Assistant Act, in Amount of $156,309,
a copy of which is hereby attached and by this reference made a
part hereof.

regularly introduced and adeopted at a regular meeting of

City Council
of said

JOINT POWERS AGREEMENT
THIS AGREEMENT, made and entered into as of the day of
1977 by and between the COUNTY OF MARIN, a political sub-
division of the State of California, hereinafter referred to as the "County" and
the CITY OF SAN RAFAEL, a municipal corporation, hereinafter referred to as "City".
WHEREAS, there is a need for additional park and recreation services and
facilities in San Rafael Planning Area and
WHEREAS, the County and City are mutually desirous of providing park and
recreation services and facilities for the residents of the abovementioned plan-
ning area.
NOW, THEREFORE IT IS MUTUALLY AGREED AS FOLLOWS:
1. County shall contribute $156,309.00 toward the construction of park
facilities within Pickleweed Park, as soon as this Joint Powers Agreement is
s igned.
2. City will be responsible for all other project costs, including but not
limited to plans, specifications, permits, construction, administration, super-
vision, maintenance and operations, and agrees to expend a minimum of $156,309.00
towards the approved project.
3• Upon completion of approved project, City shall send copy of Notice of
Completion to County.
4. City shall maintain satisfactory financial accounts, documents, and
records for the project and shall make them available to County upon request.
5• City matching funds may be in the form of money, in-house labor, and/or
donations.
6. City will not discriminate against any County resident in regard to use
of said park facilities.
7. City shall be responsible for the maintenance of said park and its recre-
ation facilities.
8. City shall indemnify, hold harmless and defend County, its officers and
employees from all claims, liabilities, causes of action and judgments for injury
or damage to persons or property arising out of or connected with use of said
park and recreation facilities.
9. City agrees to complete project within two years of receipt of County
funds. If project is not completed at the end of two years, City agrees to
return to the County all unused County contributed funds. City may request an
extension of time from County. If an extension is granted, a new completion
date will be set under the same terms herein stipulated above.
