HomeMy WebLinkAboutResolution No. 5357RESOLUTION NO. 5357 RESOLUTION ORDERING VACATION OF ALICE STREET, SAN RAFAEL, CALIFORNIA (Unpaved Portion, South of Mission Avenue) WHEREAS, the City Council of the City of San Rafael, on the lst day of August, 1977, passed and adopted Resolution No. 5339, entitled, "RESOLUTION OF INTENTION TO ORDER VACATION OF ALICE STREET, SAN RAFAEL, CALIFORNIA," and WHEREAS, notice was published and posted as re- quired by law, and WHEREAS, a hearing was had this day as required by law, and said Resolution No. 5339, at which hearing the Council of the City of San Rafael heard evidence offered by all persons interested in or objecting to the vacation here- inafter ordered, and WHEREAS, it appears from the evidence offered and from all of the evidence submitted, and the said Council finds, that the street herein described is unnecessary for present or prospective public street purposes, NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED that ALICE STREET, located in the City of San Rafael, Cali- fornia, hereinafter more particularly described, is unnecessary for present or prospective public street purposes and is hereby vacated. The public street proposed to be vacated is located in the City of San Rafael, State of California, designated as Alice Street, and is more particularly described as follows: BEGINNING at the Northeasterly corner of that certain parcel of land as described in the Deed from Antonette Ferrario to Margaret Cartwright recorded January 31, 1949 in Book 607 of Official Records at page 200, Marin County Records, said point of beginning being also on the Southerly line of Mission Avenue, thence along the Easterly line of said Cartwright parcel, south 150 34' West - 1 - 113.9 feet to the Southeasterly corner thereof; thence Southeasterly in a straight line, 20.0 feet, more or less, to the most Southwesterly cor- ner of that certain parcel of land as described in the Deed from San Rafael Development Company, a corporation, to C. A. Bassart, recorded March 16, 1920 in Book 211 of Deeds at page 483, Marin County Records, thence along the Westerly line of said Bassart parcel and its direct extension, Northerly, a distance of 111.7 feet to the Southerly line of Mission Avenue; and thence Westerly along said South- erly line 20.0 feet, more or less, to the point of beginning. I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regu- larly introduced and adopted at a REGULAR meeting of the Council of said City held on TUESDAY, the 6th day of SEPTEMBER, 1977, by the following vote, to wit: AYES: COUNCILMEN Miskimen, Mulryan, Nixon and Vice -Mayor Jensen NOES: COUNCILMEN None ABSENT: COUNCILMEN Mayor Betti ni L,dEA.',.,TNE M.
