RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AMENDING THE MASTER FEE SCHEDULE BY ADDING A BUSINESS LICENSE FEE
FOR SKATEBOARD PARKS TO THE SCHEDULE
WHEREAS, Title 10, Chapter 4, Section 040, of the San Rafael
Municipal Code provides that the City Council shall adopt business
license fees by Resolution;
WHEREAS, skateboarding has become extremely popular;
WHEREAS, it is anticipated that one or more skateboard parks
will be established within the City of San Rafael;
NOW, THEREFORE, BE IT RESOLVED by the San Rafael City Council
that pursuant to the authority of Section 10.4.040 of the San Rafael
Municipal Code, business license fees for the operation of a skateboard
park will be six percent (6a) of the gross receipts from general
admissions.
Prior to securing the business license, the applicant shall
estimate the gross receipts for the time period to be covered by the
license. If the Business License Administrator accepts the estimate
as reasonable, that estimate shall be used in determining the amount
of license tax. However, the estimated amount is a tentative payment
only, and the licensee shall, within thirty (30) days after the ex-
piration of the time period for which the license was issued, and prior
to reissuance of a renewal license, furnish the Business License
Administrator with a sworn statement upon a form furnished by the
Business License Administrator showing the actual gross receipts
during said period of operation. The business license tax will then,
finally be ascertained for the period covered and an adjustment made
by refunding any excess payment to the licensee or payment to the City
for any balance due.
