A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf
of the City of San Rafael a lease or agreement with
FIRST ASSEMBLY OF GOD CHURCH - EASTER SUNRISE SERVICES ON SAN RAFAEL
HILL
A copy of which is hereby attached and by this reference made a part
hereof.
I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby
certify -that the foregoing resolution was duly and regularly introduced
and adopted at a
regular meeting of the City Council of said
City held on Monday the 5th _ day of April
19 76 , by the following vote, to wit:

THIS AGREEMENT entered into on this 5th day of
April, 1976, between the CITY OF SAN RAFAEL (hereinafter called
the Party of the First Part), and the ASSEMBLIES OF GOD OF NORTHERN
CALIFORNIA & NEVADA DISTRICT COUNCIL (hereinafter called the Party
of the Second Part);
WHEREAS, the First Party, without consideration and solely
for the accommodation of the Second Party, agrees to permit the
Second Party to conduct Easter sunrise services on San Rafael Hill.
In consideration of the Party of the First Part permitting the Party
of the Second Part to utilize their property for these religious pur-
poses, the Party of the Second Part agrees to hold the Party of the
First Part harmless for any liability which may occur as a result of
the religious services being conducted on the Party of the First Part's
property on Easter Day, April 18, 1976.
WHEREAS, the Party of the Second Part hereby agrees to in-
demnify the Party of the First Part and their respective legal repre-
sentatives from and against all'demands, claims, action, losses and
expenses arising therefrom.
Prior to execution of this Agreement by the City, the Party
of the Second Part must furnish evidence in the form of a Certificate
of Insurance of Party of the Second Part of Comprehensive General
Liability in the amount of $100,000.00 for injury to each person,
$300,000.00 for each occurrence, and $2,000,000.00 of comprehensive
excess indemnity. For the purpose of this Agreement, a certificate
of insurance reflecting that the Party of the First Part is carried
as an additional insured for the purposes of the Easter Day ceremonies
on April 18, 1976 would be satisfactory.
