RESOLUTION AUTHORIZING THE SIGNING OF A GRANT OF EASEMENT
TO PACIFIC GAS AND ELECTRIC COMPANY FOR INSTALLATION AND
MAINTENANCE OF UNDERGROUND SPLICE BOX AT FIFTH AVENUE AND
'D' STREET
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf
of the City of San Rafael a Grant of Easement with Pacific Gas and
Electric Company for installation and maintenance of underground splice
box at Fifth Avenue and 'D' Street. A copy of said Grant of Easement is
hereby attached and by this reference made a part hereof.
I, MARION A. GRADY, City Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a REGULAR meeting of the City Council of said City
held on MONDAY, the 3RD day of MAY, 1976, by the following vote, to wit:

CITY OF SAS! RAFAEL, a public body of the State of California
first party, hereby grants to PACIFIC GAS AND ELECTRIC COMPANY, a California
corporation,
second party, the right from time to time to construct, install, inspect, maintain, replace,
remove, and use facilities of the type hereinafter specified, together with a right of way
therefor, within a strip or parcel of land or along a route as hereinafter set forth, and also
inress thereto and egress therefrom, over and across the lands s;tuate in the City of
_Tan Rafael County of Marin , State of California, described
as follows:
The parcel of land conveyed by Johanna Fabre and others to City of
San Rafael, by deed dated February 2, 1974 and recorded in Book 2672
of Official Records at page 592, Marin County Records.
Said facilities shall consist of:
Such underground conduits, pipes, manholes, service boxes, wires, cables,
and electrical conductors; aboveground marker posts, risers, and service
pedestals; underground and aboveground switches, fuses, terminals, and
transformers with associated concrete pads; and fixtures and appurtenances
necessary to any and all thereof, as second party deems necessary located
within the parcel of land outlined by heavy dashed lines on the print of
second party's Drawing No. LN 7180 attached hereto and made a part hereof.

First party shall have the right to landscape the parcel of land hereinbefore
described.
First party shall not erect or cunstruct any building or other structure or -drill or operate ,any well
within -_the ,.p reel_ of land outlined by the heavy dashed lines.
The provisions hereof shall inure to the benefit of and bind the successors and assigns of the
respective parties hereto.
