HomeMy WebLinkAboutResolution No. 5119RESOLUTION NO. 5119 A RESOLUTION AUTHORIZING THE SIGNING OF A LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a lease or agreement with the San Rafael Redevelopment Agency (second amendment to the Repayment Contract, Central San Rafael Redevelopment Project --pertaining to purchase of Parking Lot Property, Fifth and "D" Streets) A copy of which is hereby attached and by this reference made a part hereof. I, MARION A. GRADY - City Cler W A AMENDMENT TO THE REPAYMENT CONTRACT CENTRAL SAN RAFAEL REDEVELOPMENT PROJECT This is the second amendment tp the Repayment Contract for the Central San Rafael Redevelopment Project made this 7th day of June , 1976, by and between the City of San Rafael (hereinafter called "City") and the San Rafael Redevelopment Agency (hereinafter called "Agency"). " --- -I - . 1. On October 8, 1973, the City and Agency entered into a Repayment Contract of which this is an amendment by which the Agency had agreed to reimburse the City for all expenses incurred in connection with capital improvements the City had' -made or in the future would make within the project area as part of the redevelopment program. 2. One of the projects which the City was they in the process of undertaking was -the acquisition of property at: 5th -and D Streets in the City of San Rafael and the subsequent improvement of said property for parking purposes in connection with the redevelopment of the downtown area within the Central San Rafael Redevelopment Project. At this time, the Agency did not have sufficient funds to undertake the acquisition and development of the site and the City therefore undertook such obligations with the understanding thcLL such costs would be reimbursed -to the City when the Agency had sufficient tax increment funds available. 3. In addition to general public parking which is provided by this facility, parking is provided in connection with the Redevelopment Agency in as much as this property is adjacent to the offices of the Redevelopment Agency. 4. In addition to the costs expended by the City for the acquisition and improvement -of this capital improvement, the Agency provided staff assistance in terms of acquisitiolz and relocation of individuals then located upon the site. 5. At the time of the initiation of this project, the Agency did not have sufficient funds to pay for purchase of the property and/or the subsequent improvements. These funds were advanced by the City in anticipation of repayment by the Agency pursuant to the Repayment Contract. 6. It has been found and determined by both the Agency and the Council that this project was, and remains, a benefit to the project area. 7. Although generally provided by paragraph 3 of the original Repayment Contract, the parties agree that the original paragraph 3 of -the Repayment Contract concerning reimbursement to the City for -2- C1-11):iLa] i.nip.covements is imprecise and that therefore said Contract should be amundod to more specifically I,)rovide for the repayment to the City for those coats incurred in the acquisition and deve- lopment of the 5th and D Streets parking lot. CITY AND AGENCY AGREE: That pursuant to paragraph 3 of the original Repayment Con- tract, the Agency shall reimburse the City for the costs of acquisition and development of the parking lot at 5th and D Streets within the Central San Rafael Redevelopment Project. It is found and determined that such parking facility was and is a benefit to the project area and that the City skull be reimbursed the following costs: Purchase of land Improvements Landscaping Total $147,431 $ 19,487 $ 2,719 $169,637 1 Said amount shall be a debt of the Agency and shall be paid to the City in the manner provided in Section 4 of the Repayment Contract.
