HomeMy WebLinkAboutResolution No. 5134RESOLUTION NO. 5134 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING RESOLUTION NO. 4985 PERTAINING TO 7HE COMPENSATION AND WORIQNG CONDITIONS FOR MISCELLANEOUS, MANAGEMENT, CONFIDENTIAL, AND UNCLASSIFIED EMPLOYEES BE IT RESOLVED by the City Council of the City of San Rafael as follows: Section 1. Salaries. Effective July 1, 1976, a salary increase of three percent (3%) shall be paid to all employees covered by this resolution and shall be applied across the board to all classifications, steps and ranges pursuant to Exhibit "A" attached. Effective July 1, 1978, a salary increase shall be paid to all employees covered by this resolution and shall be applied across the board to all classifi- cations, steps and ranges, equal to the increase in the Consumer Price Index, All Items, for Urban Wage Earners and Clerical Workers (San Francisco -Oakland, California) for the period March 31 , 1977 to March 31 , 1978, not to exceed five percent (5%). Section 2. Revised Salary Schedule. (Refer to Exhibit "A") Section 3. Salary Designations. The salaries herein established are monthly compensation unless otherwise specified. Section 4. The Administration of the Pay Plan. Salary advance shall be made on the basis of the salary rates, salary ranges and salary steps set forth opposite each classification in this resolution. Before any person is advanced to the next step, a written statement must be filed by the Department Head with the City Manager recommending such increase. The steps of each salary range shall be applied as follows: The first step is the minimum rate and shall normally be the hiring rate for the class. In cases where it is difficult to secure qualified personnel, or if a person of unusual qualifications is engaged, the City Manager may hire at a higher step. The remaining steps repre- sent the ordinary next salary steps for each year of service, providing the employee is qualified in his work to receive the next step. Anni- versary date shall be interpreted as the 1st day of the month for those employees entering the service between the 1st and 15th of the month, and on the 1st day of the next month for those entering the service after the 15th of the month. The semi-monthly pay period shall be the 15th and the last day of each month. I . u" �1 I [rllw' rl" N "A L' Section 5. Appointments and Salaries. The City Manager in accordance with the Personnel Rules and Regulations may make appointments of prospective employees to a position in a class for which the salary is herein provided and designate the definite salary rate or salary step at which such person is appointed. The salary so designated is thereby fixed as the salary of such employee for such position; provided, further, that the City Manager may from time to time increase or decrease the salaries of persons so appointed in accordance with provisions of Section 1, provided that the salary so fixed is within the ranges established for that class. The City Manager is empowered to place unclassified personnel at any point within the minimum and maximum salary range established for that classification. Section 6. Parttime and Temporary Employment. Employees appointed to any of the positions referred to herein and employed or working on a parttime basis shall be paid in proportion to the time worked and described in their appointment. Temporary employees may be appointed by the City Manager when authorized budget funds are available. Section 7. Stand -By and Call -Back Duty Pay. When a miscellaneous employee is assigned stand-by duty on Saturday, Sunday or a day designated as an authorized holiday by the City Council, said employee shall be compensated at the rate of six (6) hours pay at a straight rate for each day of stand-by duty. In addition, if said employee is called out and required to work over and above the stand-by duty, he or she shall receive a minimum of two (2) hours pay at the rate of time and one-half. Section B. Overtime. All miscellaneous employees with the exception of department heads and supervisory personnel, who are required to work in excess of their basic work week. during any one week shall be given compensatory time off at the rate of time -and -one-half, or, upon the recommendation of the Depart- ment Head and subject to approval of the City Manager, shall be paid at the rate of time -and -one-half of their established hourly rate, based on their regular monthly salary. Section 9. Educational Incentive. Upon prior approval of the City Manager and Department Head, an employee may be reimbursed for a certain amount of the costs of tuition and/or books at an accredited or approved school. This program requires that the schooling must continue to pertain to the employee's present position, or for an advanced classification within the department. The maximum amount payable to an employee for any semester shall be Seventy -Five Dollars ($75.00), the City's contribution not to exceed 75% of the total cost. A passing grade must be received by the employee to qualify for reimbursement. 2. Section 10. Sick Leave. Upon termination of employment, by resignation, retirement or death, a miscellaneous employee who leaves the municipal service in good standing shall receive compensation for all accumulated unused sick leave based upon the rate of two percent (2%) for each year of service, to a maximum of fifty percent (50%). Section 11. Holiday Pay. All employees who are required to work on a day designed as an authorized holiday other than a day which an election is held through- out the State, shall be paid in addition to their regular salary for the number of hours worked during such a day at the rate of straight time, or shall be given compensatory time off at a straight time rate at the discretion of the City Manager. Section 12. Automobile Allowances. All employees and City Officials shall be reimbursed at the rate of seventeen cents (171#) per mile for use of their private cars when traveling on authorized City business. Section 13. Insurance Program. Effective July 1, 1977, as an added fringe benefit, a maximum amount of Eighty -Seven Dollars and Fifty Cents ($87.50) per month will be contributed towards the cost of each eligible employee's Health, Accident, Life, and Disability Insurance Package. Selection of coverage must include the employee's basic health plan and $5,000.00 life insurance policy offered by the City. Effective July 1, 1978, as an added fringe benefit, a maximum amount of Ninety -Seven Dollars and Fifty Cents ($97.50) per month will be contributed towards the cost of each eligible employee's Health, Accident, Life, and Disability Insurance Package. Selection of coverage must include the employee's basic health plan and $5,0000.00 life insurance policy offered by the City. Section 14. Dental Insurance. Effective July 1, 1976, the City will provide and pay the premiums to have a dental insurance program carried by the California Dental Service, Program III A, as shown in CDS proposal dated May 7, 1976, at the premium rate quoted therein under the heading "Super -Composite." In the event that the rate is increased at any time after July 1, 1978 but before June 30, 1979, the City shall continue the Program and shall pay the increased rate from the date of the increase for the term of this resolution, to the extent that said increase does not exceed ten percent (10%); any increase exceeding that percentage shall be repaid to City by a reduction in monthly salaries across the board in an amount equal to the monthly increase in the premium rate, to the extent that it exceeds ten percent (10%). 3. Section 15. Health Plan Coverage. The City's contribution for the health plan coverage which includes major medical and hospitalization for former City employees currently receiving regular service retirement benefits and who currently have health plan coverage under the City's group policy will be made on the basis of costs for the employee and one (1) dependent. This benefit is subject to annual review. Section 16. Retirement Program. Effective July 1, 1977, the City will join the "present" system of the Employees' Retirement Association of the County of Marin as described in the actuarial studies performed by Coates, Herfurth & England, dated April 29, 1976 and July 1, 1975, on behalf of all employees covered by this resolution, including both general and safety personnel, and including active and inactive retired members, as set forth in said actuarial studies; provided, however, that if City fails to join as of July 1, 1977, the above-mentioned "present" system of the Marin County Employees' Retirement Association, on behalf of all the above- mentioned employees, for whatever reason, including but not limited to the failure to fulfill any condition precedent to the City's entry into such system, the parties to this resolution shall reopen the process of meeting and conferring in good faith with respect both to all matters covered by this resolution and all matters within the scope of meeting and conferring, and all provisions of this resolution and all matters within the scope of meeting and conferring shall be renegotiated retroactive to July 1, 1976. Section 17. Vacation. Each full-time eligible employee shall accrue vacation at the following rate for continuous service: a. Less than three (3) years b. Three (3) but less than ten (10) years c. Ten (10) but less than fifteen (15) years d. Fifteen (15) or more years 10 working days per year; 15 working days per year; 20 working days per year; 25 working days per year. Vacation Conversion. Unclassified employees may request that accrued vacation, not to exceed seven (7) days, be converted to cash payments in any calendar year and may be granted at the discretion of the City Manager. Section 18. Floating Holiday. City agrees to take appropriate action to delete as holidays granted to the employees covered by this resolution the following: Good Friday and Lincoln's Birthday, and to add one (1) floating holiday per year, to be taken by the covered employee subject to the consent of his or her Department Head. 0 Section 19. Sections 1 .5 and 5 as stipulated in Resolution No. 5135 shall apply to all Unclassified employees. Section 20. Title of Resolution. This resolution shall be known as the Position and Salary Resolution and shall be referred to as such. Section 21. This resolution shall take effect forthwith upon its adoption and the several compensations and allowances herein provided shall be in full force and effect as of and from July 1, 1976 through June 30, 1979.
