RESOLUTION OF THE CITY OF SAN RAFAEL ACCEPTING GRANT DEED
AND AUTHORIZING EXECUTION OF ESCROW INSTRUCTIONS, EAST
SAN RAFAEL DRAINAGE ASSESSMENT DISTRICT NO. 2
WHEREAS, the public interest, convenience, necessity and
welfare require that the real property and drainage easement herein-
after mentioned be accepted and used for the benefit of the public
of the City of San Rafael, California; and
WHEREAS, as a requirement of the conveyance and acceptance
of said real property and drainage easement, the City must execute
certain escrow instructions,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of San Rafael, does hereby accept that certain Grant Deed from
Stanley Herzstein, Trustee, dated October 15, 1975, and the real prop-
erty and drainage easement described therein, a copy of which Grant
Deed is attached hereto and incorporated herein by reference, and the
Clerk of said City is hereby directed to cause said Grant Deed to be
duly recorded in the Office of the Marin County Recorder upon the
adoption of this resolution.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are
hereby authorized to execute on behalf of the City of San Rafael, the
required escrow instructions necessary to complete the conveyance of
said real property and drainage easement, a copy of which instructions
is attached hereto and incorporated herein by reference.
I, MARION A. GRADY, Clerk of the City of San Rafael, California,
HEREBY CERTIFY that the foregoing resolution was duly and regularly intro-
duced and adopted at a REGULAR meeting of the Council of said CITY held on
the 3RD day of NOVEMBER, 1975, by the following vote, to wit:
AYES: COUNCILMEN Jensen, Miskimen and Mulryan
NOES: COUNCILMEN None
ABSENT: COUNCILMEN Mayor Bettini
ABSTAIN: COUNCILMEN Nixon
