A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL CONSENTING TO THE TRANSFER OF TERRITORY
DESIGNATED AS THE LANDS OF LINCOLN TRANSFER FROM
THE CITY OF SAN RAFAEL TO THE CITY OF LARKSPUR
WHEREAS, the City of Larkspur is requesting the transfer of certain territory
from the City of San Rafael to the City of Larkspur; and
WHEREAS, on December 17, 1975, the Marin Local Agency Formation Commis-
sion considered said transfer proposal and adopted Resolution No. 75-35 making
determinations and approving said transfer; and
WHEREAS, Resolution No. 75-35 adopted by the Marin Local Agency Forma-
tion Commission designated the transfer proposal as the "Lands of Lincoln Transfer",
and found that the territory of the transfer was uninhabited; and
WHEREAS, following approval of the Local Agency Formation Commission
further proceedings on the transfer may be taken pursuant to Article 4.5 ( commending
with Section 35270) of Chapter 1, Part 2, Division 2, Title 4 of the Government Code;

WHEREAS, the transfer of territory has been reviewed and approved by the
Planning Commission of the City of San Rafael; and
WHEREAS, it is the intent and purpose to retain in perpetual open space
thos lands transferred to Larkspur; and
WHEREAS, pursuant to Section 35271 of Article 4.5, the City from which territory
is proposed to be transferred must consent to said transfer by resolution adopted by
its City Council;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San
Rafael does hereby resolve, determine and order as follows:
1. The Council hereby does consent to the transfer of territory designated
as "Lands of Lincoln Transfer" from the City of San Rafael to the City of Larkspur.
2. The Clerk of this Council is hereby directed, and shall, submit a certi-
fied copy of this Resolution to: The Marin County Board of Supervisors, the City of
Larkspur and the Marin Local Agency Formation Commission.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify that
the foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City held on Monday the 5th day of
January , 1976, by the following vote, to wit:
AYES: COUNCILMEN: Miskimen, Mulryan, Nixon and Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Jensen
