RESOLUTION AUTHORIZING REDUCTION IN THE RETENTION OF MONEYS
UNDER THE CONTRACT FOR THE CONSTRUCTION OF ALBERT PARK COM-
MUNITY RECREATION CENTER, CITY OF SAN RAFAEL, MARIN COUNTY,
CALIFORNIA
WHEREAS, contract was entered into between the City of
San Rafael and FRANCIS CONSTRUCTION, for the construction of the Albert
Park Community Recreation Center, which contract was dated the 20th day
of January 1975; and
WHEREAS, the contractor has completed most of the work called
for in the contract; and
WHEREAS, the work remaining to be done is the finishing of a
few "punch list items" and completion of Contract Change Orders generated
by the City at the very end of the project; and
WHEREAS, it is desired to reduce the amount of moneys retained
from the final payment to the contractor;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of San Rafael, Marin County, California, as follows:
1. That Article 5, "Progress Payments", and Article 6,
"Final Payment", of the Standard Form of Agreement
Between Owner and Contractor, and Article 9, "Pay-
ments and Completion", of the General Conditions of
the Contract for Construction be, and they are hereby,
amended to provide that the retention of said contract
be reduced so as to allow partial payment of the reten-
tion at this time, to Francis Construction, in the
amount of $38,035.97.
2. That said partial payment of the retention shall not
be released by the City to the contractor until City
has received written consent of the Surety to reduction
in or partial release of the retainage in said project.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a REGULAR meeting of the Council of said City on TUESDAY,
the 17TH day of FEBRUARY, 1976, by the -following vote, to -wit:
AYES: COUNCILMEN; Jensen, Miskimen and Acting Mayor Mulryan
