A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL APPROVING THE ANNEXATION
OF THE TERRITORY DESIGNATED AS "NIKE CONTROL
SITE ANNEXATION" TO THE CITY OF SAN RAFAEL
WHEREAS, the City of San Rafael, a municipal corporation, is the owner
of the uninhabited territory described on Exhibit "A" which is attached hereto and
incorporated herein by reference, which territory is contiguous to land lying with
the boundary of said City; and
WHEREAS, it appears that it will be to the advantage, benefit and best
interest of said City to annex said territory to said municipal corporation; and
WHEREAS, said annexation proceedings are being taken under the pro-
visions of "Annexation of Uninhabited Territory Act of 1939"; and
WHEREAS, an application for the above described annexation has hereto-
fore been filed with the Local Agency Formation Commission which application
was presented by the City of San Rafael as owner of the land; and
WHEREAS, the Local Agency Formation Commission did, on the 18th day
of February, 1976, approve the annexation of said uninhabited territory of the City
of San Rafael and in accordance with the provisions of the Knox -Nisbet Act, Chapter
6 (commencing with Section 54773) of Division 2, Title 5 of the Government Code
the Local Agency Formation Commission approved and authorized the Council of the
City of San Rafael to annex said territory, without notice, hearing or election by
said City; and

WHEREAS, no protest has been made against the above described annexa-

described as Exhibit "A" to the City of San Rafael and elects to proceed with said

NOW, THEREFORE BE IT RESOLVED as follows:
1. The said City Council hereby approves the annexation of the territory
described on Exhibit "A" to the City of San Rafael, and said territory is hereby
annexed to the City of San Rafael.
2. That the territory herein annexed is all that certain real property
situated in the County of Marin, State of California, described on Exhibit "A",
which territory is hereby designated as "Nike Control Site Annexation".
3. The Clerk of the City of San Rafael shall immediately prepare under
the seal of the City of San Rafael, a certified copy of this Resolution, giving the
date of its passage, and transmit it to the Secretary of State of California.

that the foregoing Resolution was duly and regularly introduced and adopted at a
regul ar meeting of the Council of said City held on the 22nd day of
March , 1976, by the following vote, to wit:

DESCRIPTION OF "NIKE CONTROL SITE"
ANNEXATION TO THE CITY OF SAN RAFAEL

Beginning at a point on the existing San Rafael City Limit line, said point
being the intersection of the courses South 77°25120" East,259.05 feet and
North 32°41'20" East,25.03 feet, said intersection being the most northwesterly
corner of the parcel described in Book 2645 of Deeds, at page 11, Marin County
Records; thence leaving said existing San Rafael City Limit line, and proceeding
North 32°41'20" East,87.22 feet; thence North 85°35'00" East,244.08 feet; thence
South 30°00'00" East,369.92 feet; thence South 44°00'00" West, 138.96 feet; to
a point on the existing San Rafael City Limit line; said point being the inter-
section of the courses South 36°48'50" East, 19.19 feet; and South 44°00' West,
21.11 feet as said intersection is described in Book 2645 of Deeds, at page 11,
Marin County Records; thence northwesterly along the San Rafael City Limit to
the point of beginning.
Parcel contains approximately 1.43 acres more or less.
