RESOLUTION ACCEPTING GRANT OF SEWER EASEMENT
WHEREAS, public interest, convenience, and welfare require that the easement
hereinafter mentioned be accepted and used for the benefit of the public of
the City of San Rafael, California;
NOW THEREFORE, be it hereby resolved by the City Council of the City of San
Rafael, California, that that certain grant of right-of-way for the mainten-
ance, repair, reconstruction and renewal of the public sanitary sewer,
executed by JOE AND ROSE M. ASCIERTO
to the City of San Rafael, dated FEBRUARY 19, 1976 ,
be, and the same is hereby accepted and the Clerk of said City is hereby
directed to cause said conveyance to be duly recorded in the office of the
County Recorder of the County of Marin, State of California, forthwith upon
the adoption of this resolution.
I, MARION A. GRADY Clerk of the City of San Rafael, California hereby
certify that the foregoing resolution was duly and regularly introduced and
adopted at REGULAR meeting of the Council of said City held
on MONDAY the 22ND day of MARCH 1976
by the following vote, to -wit:
AYES: COUNCILMEN: Miskimen, Mulryan, Nixon and Mayor Bettini
NOES: COUNCILMEN: None

GRANT OF EASEMENT FOR CONSTRUCTI(GIr
AND MAINTENANCE OF SANITARY SEWER
We JOE and ROSE M. ASCIERTO (hereinafter called
"Grantor" without regard to number or gender) for an adequate consideration hereby
GRANTS and conveys to the CITY OF SAN RAFAEL, a municipal corporation, an EASEMENT
over the strip of land hereinafter described for the purpose of laying down,
installing, constructing, renewing, inspecting, maintaining, repairing and using
a public sanitary sewer on or under said strip of land together with the right
of ingress thereto and egress therefrom, in, on and across said strip of land and
the contiguous real property of Grantor.
An easement for sanitary sewer purposes, situated in Sunset Way Drive and
West Crescent Drive and in Lots: 5, 6, 25, 4, 26, 27, 28, as designated
on the map entitled: "Map of Westland Terrace; Sub. Two; San Rafael, Calif"
filed for record in the office of the County Recorder of Marin County, August
16, 1946, Book 6, page 16. All in the City of San Rafael, County of Marin,
State of California, described as follows:
That portion of the above described easement which lies in Lot Number 27,
and may be described as: Beginning at the southeast property corner of
Lot # 27; thence N17°24'E, 7-1/2 feet; thence N72°36'W, 70 feet; thence
S17024'W, 11 feet + to the southwest property corner of Lot # 27; thence
S76°52'50" E, 49.528 feet; thence S72°36'E, 20.61+ feet to the point of
beginning.
An additional 5 feet of width, adjacent to that granted above, is granted
as a temporary work easement to allow construction of the sanitary sewer
facilities. This temporary work easement shall cease upon the completion
of the work.
Grantor shall not plant, place or deposit anything in or on said strip of
land which will damage or interfere with any of the rights granted hereunder nor
shall Grantor erect or construct any building or other structure or drill or operate
any well within said strip of land.
The provisions hereof shall inure to the benefit of and bind the heirs,
successors, and assigns of the respective parties hereto.
Should there by any variation, errors, or omissions in the description
herein, it is the intention of the Grantor to eonvey the City, a right-of-way over
the pipeline and other installations as laid and located.
