A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf
of the City of San Rafael a lease or agreement with
Joint Powers Agreement with San Rafael School District (for school
sites resurfacing)
A copy of which is hereby attached and by this reference made a part
hereof.
I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the City Council of said
City held on Monday the 2nd _ day of August ,
19 76 , by the following vote, to wit:

JOINT
POWERS AGREEMENT
THIS AGREEMENT, entered into this day
of , 1976, by and between the CITY OF SAN RAFAEL,
hereinafter referred to as "City", and the SAN RAFAEL SCHOOL
DISTRICT, hereinafter referred to as "District, for the fiscal
year 1976-77.
WITNESSETH:
WHEREAS, both City and District are authorized by
law to make necessary repairs to City streets and School property
respectively; and
WHEREAS, District is desirous of having certain
asphalt resurfacing work done per Exhibit "A" attached hereto; and
WHEREAS, City is desirous of asphalt resurfacing those
certain City streets as shown on Exhibit "B" attached hereto; and
WHEREAS, it is mutually desirous that the work on both
projects be accomplished by the same contractor under a single
contract.
NOW, THEREFORE, IT IS HEREBY AGREED by and between the
parties hereto as follows:
1. City shall prepare the bid documents for the comple-
tion of the work shown on Exhibits "A" and "B", and shall administer
the contract granted to the successful bidder.
2. The City bid documents for the asphalt resurfacing
of those certain City streets as shown on Exhibit "B" attached hereto,
shall include an alternate provision whereby the contractor shall
complete the necessary asphalt resurfacing as per Exhibit "A" attached
hereto, pursuant to the specifications provided City by District.
3. The contract between City and the successful bidder
shall include the alternate for the District asphalt resurfacing
work if the District advises City that the bid is acceptable on that
portion of the work within one day of bid opening.
4. It will be the responsibility of the District to
provide any necessary site preparation.
5. District shall furnish one full-time inspector
for the duration of the work, who will be responsible for insuring
that the District portion of the work is in accordance with plans
and specifications, and shall furnish City with certified daily
material receipts for processing of payments to Contractor.
6. Upon completion of the project City shall bill
District for District's portion of the work as shown on Exhibit "A"
attached hereto, and District shall promptly pay for same.
IN WITNESS WHEREOF, the parties hereto have executed
this Joint Powers Agreement on the day and year first above written.
