RESOLUTION OF AWARD OF CONTRACT
WHEREAS, on the 11th day of AUGUST, 1976, pursuant to due
and legal notice published in the manner provided by law, inviting
sealed bids or proposals for the work hereinto mentioned, as more fully
appears from the Affidavit of Publication thereof on file in the office
of the City Clerk of the City of San Rafael, California, the City Clerk
of said City did publicly open, examine, and declare all sealed bids or
proposals for doing the following work in said City, to wit:
RESURFACING OF VARIOUS STREETS - 1976
PROJECT NO. 76.113
in accordance with the plans and specifications therefor on file in the
office of said City Clerk; and
WHEREAS, the bid of GHILOTTI BROS., INC., at the unit prices
stated in its Base Bid,in Alternate A, and in Alternate B, was and is the
lowest and best bid for said work and said bidder is the lowest responsible
bidder therefor; and
WHEREAS, the bid for Alternate B involves work on Mooring Road,
a private street, currently in a rather hazardous condition, which is
continually used by the public;
NOW, THEREFORE, IT IS HEREBY ORDERED AND RESOLVED that the bid
of GHILOTTI BROS., INC. be and the same is hereby accepted at said unit
prices for the Base Bid, Alternate A, and Alternate B, and that the con-
tract for said work and improvements be and the same is hereby awarded to
said GHILOTTI BROS., INC. at the unit prices for the Base Bid and Alternate
A, and Alternate B being subject to the assignment of surplus Assessment
District funds to the City of San Rafael by each property owner of record
within the Mooring Road Sewer Assessment District for reimbursement of all
associated costs for the resurfacing of Mooring Road;
IT IS FURTHER ORDERED AND RESOLVED that any and all certified
checks, cash, or bond accompanying the bids of unsuccessful bidders be
forthwith returned to them respectively;

IT IS FURTHER ORDERED AND RESOLVED that the City Engineer is
hereby authorized to proceed with the resurfacing of Mooring Road when
all funding has been received and Contractor is hereby ordered not to
proceed with this Alternate B work until specifically ordered in writ-
ing by the Engineer, and to extend the time for completion of the con-
tract as set forth herein upon showing of good cause by the Contractor;
IT IS FURTHER ORDERED AND RESOLVED that the Mayor and the
City Clerk of said City be authorized and directed to execute a contract
with GHILOTTI BROS., INC. for said work and to return the bidder's bond
upon the execution of said contract.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a REGULAR meeting of the Council of said City on MONDAY,
the 16TH day of AUGUST, 1976, by the following vote, to -wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini
