A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf
nf the City of San Rafael a lease or agreement with
Mr. Keith Dale for Construction of Gaze o
at Falkirk Community Cultural Center
A copy of which is hereby attached and by this reference made a part
hereof.
I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the City Council of said
City held on Monday the
19 76 , by the following vote, to wit:

AGREEMENT FOR CONSTRUCT. J OF GAZEBO FOR FALKIRK Cc 4UNITY CULTURAL CENTER
THIS AGREEMENT, made and entered into this day of August,
1976, by and between KEITH DALE, 14 Gomez Way, Mill Valley, California,
(hereinafter called "Contractor") and the CITY OF SAN RAFAEL, a municipal
corporation of the State of California, (hereinafter called "City");
WITNESSETH
That the City and the Contractor, for the consideration herein-
after named, agree as follows:
1. The Contractor hereby agrees to furnish all the materials
and all the egiipment and labor necessary to build a Gazebo for Falkirk
Community Cultural Center in accordance with the design approved by the
City Council.
2. Contractor agrees to complete the building of said Gazebo
on or before August 29, 1976.
3. Time is of the essence and, if said Gazebo is not completed
on or before August 29, 1976, Contractor shall not be entitled to any com-
pensation for labor expended or cost of equipment or materials.
4. City and Contractor agree that the final design and color
must meet the approval of the Cultural Affairs Commission of the City and
the City Manager.
5. Upon completion of the Gazebo and final acceptance by the
City, the City shall pay the Contractor the sum of $500.00 within 15 days
from the date of acceptance.
6. Upon completion of the construction of the Gazebo, the
Gazebo shall become the property of the City of San Rafael.
7. Contractor hereby agrees to, and shall, indemnify and save
harmless the City of San Rafael, its officers, agents and employees, from
any and all loss, damage, liability, expense, claims, suits and demands
of whatever character, directly or consequently arising out of or in con-
nection with this construction.
IN WITNESS WHEREOF, the parties hereto have executed this Agree-
ment on the day and year first above written.
