HomeMy WebLinkAboutResolution No. 5167RESOLUTION NO. 5167 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING THE GENERAL PLAN BY ADDING A RECREATION PARKS ELEMENT AND FINDING THAT A NEGATIVE DECLARATION IS APPROPRIATE WHEREAS, the City of San Rafael in 1974 adopted a General Plan containing all nine elements required under the Government Code of the State of California; and WHEREAS, immediately thereafter the City embarked upon the implementation of said Plan; and WHEREAS, Recreation Parks constitute a significant factor of the local cultural and environmental balance that warrants the detailed kind of analysis of goals and implementation as is repre- sented in the General Plan; and WHEREAS, the Parksand Recreation Commission, Planning Commission and City Council held public hearings on said Element in 1975 and in response to public comments proceeded with additions and revisions to the draft of said Element; and WHEREAS, the Parksand Recreation Commission has further approved changes made in response to such public input and recom- mended same to the Planning Commission; and WHEREAS, the Planning Commission published notice of a public hearing on July 1, 1976 in the Independent Journal and held said hearings at its regularly scheduled meeting of July 13, 1976; and WHEREAS, at said hearing the Planning Commission considered both the amendment to the General Plan and the appropriateness of the prepared Negative Declaration on the environmental impact of said Plan and provided full opportunity to all who wished to be heard to express themselves on same; and WHEREAS, none appeared to comment on said Plan other than the favorable comments of record from the Parkland Recreation Commission; and WHEREAS, on July 13, 1976 the Planning Commission of the City of San Rafael made findings of fact that the adoption of the - 1 - Recreation Parks Element would not have a significant negative environmental impact and favorably recommended to the City Council that an environmental impact Negative Declaration be issued; and that the General Plan of the City of San Rafael be amended to add thereto an additional Chapter which shall be known as Chapter VIII, Recreation Parks, and that the content of said Chapter shall be the Recreation Parks Plan herein adopted and made a part of the minutes of the Planning Commission meeting of July 13, 1976; and WHEREAS, this Council finds that the impact on the envi- ronment will be favorable, no environmental impact report is needed, and that the issuance of the environmental impact Negative Declaration is appropriate; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael does hereby: 1. Issue an environmental impact Negative Declaration for the Recreation Parks Element of the General Plan; 2. Amend the General Plan of the City of San Rafael by adding thereto an additional Chapter which will be numbered Chapter VIII entitled "Recreation Parks". And further, the Council adopts the contents of said Chapter as recommended by the Planning Commission and made a part of their minutes of the meeting of July 13, 1976. I, MARION A.
