HomeMy WebLinkAboutResolution No. 5173RESOLUTION NO. 5173 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ORDERING ABATEMENT OF A NUISANCE WHEREAS, pursuant to Title 1, Chapter 1.20, Sections 1.120.060, 1.120.070, and 1.120.080 of the Municipal Code of the City of San Rafael, Mr. Louis Yuvan was notified that the premises which he owns, situate in the City of San Rafael, State of California, known and designated as 54 Mooring Road, in said City, and more particularly described as a houseboat moored at said address, constitutes a public nuisance; and WHEREAS, pursuant to Section 1.20.090, a hearing was duly held before the City Council of the City of San Rafael; and WHEREAS, said hearing was held on September 7, 1976, and after con- sidering the oral and written evidence presented, Council determined that: Mr. Louis Yuvan has in the past, and is now, mooring a houseboat in the San Rafael Canal in the vicinity of 54 Mooring Road in such a manner as to create an eyesore to the immediate neighborhood which is detrimental to neigh- bors' property values, an obstruction to the view, and unsightly to passerbys. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael, pursuant to Section 1.20.110 does hereby declare a public nuisance exists on said premises and that there is sufficient cause to abate same; BE IT FURTHER RESOLVED that the Owner having charge and control of said premises shall abate such nuisance by removing the houseboat and all its appurtenances from its present location within the residential areas, and any area other than a boat repair yard or designated boat harbor. BE IT FURTHER RESOLVED that the Owner of said premises shall commence abatement upon receipt of a copy of this Resolution and abatement shall be com- pleted within thirty (30) calendar days of receipt of said Resolution. If such nuisance is not completely abated by the owner as directed within the designated abatement period, then the City Manager, or such other City official as may be designated by him, is authorized and directed to cause the same to be abated by the City either through the use of its own employees or private contract, and the City Manager (or his designated agents) is express- ly authorized to enter upon the premises for such purpose.
