RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING THE REMOVAL OF ILLEGALLY PARKED VEHICLES
IN PARKING STALLS ON CITY PROPERTY DESIGNED FOR
THE EXCLUSIVE USE BY PHYSICALLY HANDICAPPED PERSONS
WHEREAS, the Department of Public Works of the City of
San Rafael has designated certain City -owned parking stalls for the
exclusive use of physically handicapped persons; and
WHEREAS, Section 5.12.090 of the San Rafael Municipal Code
allows the City to designate tow -away areas by Resolution; and
WHEREAS, it is the City's intent to vigorously enforce the
proper usage of those parking stalls designated for the exclusive use
of physically handicapped persons as defined in California Vehicle
Code Sections 22511 and 22511.5; and
WHEREAS, such vigorous enforcement of these parking stalls
is necessary for the general health, benefit, and safety of the citizens
of San Rafael;
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
That the City Police are authorized to cause the removal of
any vehicle not displaying the distinguishing license plates of the
physically handicapped person, parked in stalls dedicated for the ex-
clusive use of the physically handicapped, and if the parking stall is
posted with a sign notifying unauthorized users that their vehicle will
be towed away.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby
certify that the foregoing Resolution was duly and regularly introduced
and adopted at a regular meeting of the Council of said City held on
Monday, the 20th day of September, 1976, by the following vote, to -wit:
AYES: COUNCILMEN: Jensen, Miskimen , Nixon and Acting Mayor Mulryan
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Mayor Betti ni
