HomeMy WebLinkAboutCM Animal Control Ordinance & Fee Schedule PPTANIMAL CONTROL San Rafael City Council Meeting –June 4, 2018 RECOMMENDED ACTION 1.Conduct a public hearing and adopt ordinance: An Ordinance Amending Chapter 6.10 of the San Rafael Municipal Code Entitled "Animals" to Adopt by Reference the Animal Control Regulations Set Forth in Title 8 of the Marin County Code, as Recently Amended, and to Amend Section 6.10.50 of the San Rafael Municipal Code Prescribing the Applicable Penalties for Violation of Animal Control Regulations. 2.Adopt a resolution amending the City of San Rafael’s Master Fee Schedule to update the City’s animal control fees. INTRODUCTION •Countywide JPA since 1979 •Amended in 1990 to clarify service levels and enforcement What does the JPA mean for County and City? •For County: •Provide countywide animal control services •Set all animal control regulations and fees •Maintain licensing enforcement services •Be responsible for sale of licenses and collection of fees •For City: •Adopt and maintain animal control ordinance and related fees that are identical to those of the County •Pay cost share (70% cities, 30% County) MARIN HUMANE –ANIMAL SERVICES AGENCY •County of Marin contracts with Marin Humane as the animal services agency •Marin Humane provides all animal control services on behalf of the County: •Animal rescues •Dog licensing •Investigations relating to animal control services •Picking up of deceased and stray animals •Sterilization of cats and dogs prior to placement •More (see contract) CONTRACT WITH MARIN HUMANE •County recently completed negotiations with Marin Humane for a new, three-year contract (July 2018 –June 2021) •Total, not-to-exceed amount: $10,750,582 •Negotiating team: County Administrator’s Office, Executive Officer of Marin General Services Agency, Larkspur City Manager, Ross Town Manager ANNUAL COST INCREASE Fiscal Year Percent Increase (%) Amount 2018-19 4.0 $3,489,769 2019-20 3.0 $3,594,462 2020-21 2.0 $3,666,351 Total $10,750,582 ANIMAL CONTROL ORDINANCE •Proposed ordinance will incorporate recently approved changes To Marin County’s Animal Control Ordinance: •Potentially Dangerous and Vicious dogs •Rabies Vaccinations -Veterinarian Reporting Requirements •Exotic animals •Add clarifying language to Penalties for Violations FEES •The last fee increase was executed in 2012 •Marin Humane completed a survey of neighboring counties (San Mateo, Contra Costa, Alameda) to assess related fees and determined that proposed fee increases are appropriate and consistent with these jurisdictions •Marin Humane confirmed that the proposed fee increases do not exceed the cost to provide the associated services •Fee increases range from $1 (for a one-year dog license) to $30 (for the fifth impoundment during a 12-month period of an unsterilized animal) FISCAL IMPACT •No fiscal impact associated with Recommended Action. •This cost is shared by all Marin County cities and the County of Marin: (70% cities, 30% County). •Each city’s cost for animal control services is calculated annually and is determined by the average percent workload. FISCAL IMPACT •City’s cost for animal control services: CITY’S COST ALLOCATION Fiscal Year Amount 2017-18 $636,994 2018-19 $670,569 (projected) Δ $33,575 RABIES VACCINATIONS -VETERINARIAN REPORTING REQUIREMENTS •There are two changes in this section: 1.Gives veterinary hospitals and clinics additional time, increasing the deadline from 10 days to 30 days, to comply with rabies vaccine reporting requirements 2.Moves the home bite quarantine fees to the fee schedule POTENTIALLY DANGEROUS AND VICIOUS DOGS •Change is required to comply with state law •Removes dogs that were identified in convicted dog fighting cases as automatically being defined as “dangerous” without a hearing EXOTIC ANIMALS •Expands the list of prohibited wild and undomesticated animals allowed to be kept in Marin County and limits organizations that can exhibit exotic animals •Purpose of the changes: •Protection of public health and safetyProtecting and recognizing the unique needs of wild or exotic animals •Reducing inhumane training techniques •Decreasing administrative effort for research and enforcement of specialized permit applications PENALTIES FOR VIOLATIONS •The proposed changes adds clarifying language to note that a violation of the animal control ordinance is subject to enforcement by the provisions of the City’s municipal code •Code enforcement authority and powers •Judicial remedies •Administrative citations •Administrative orders
