RESOLUTION DIRECTING THE FILING OF A THIRD
AMENDED ENGINEER'S REPORT AND A THIRD AMENDED
ESTIMATE OF COST, EAST SAN RAFAEL DRAINAGE
ASSESSMENT DISTRICT NO. 2, CITY OF SAN RAFAEL,
MARIN COUNTY, CALIFORNIA
WHEREAS, on the 5th day of August, 1974, the City Council of
the City of San Rafael, Marin County, California, preliminarily adopted
the Amended Engineer's Report and Amended Estimate of Cost filed pur-
suant to the Resolution of Intention, as amended, in the East San
Rafael Drainage Assessment District No. 2, City of San Rafael,
Marin County, California; and
WHEREAS, since the filing of said Amended Report and Amended
Estimate of Cost, bids were received and the low bid was in excess
of the Amended Engineer's Estimate of Cost; and
WHEREAS, the Engineer of Work filed a Second Amended Engineer's
Report to conform to the low bid received on September 19, 1974; and
WHEREAS, by resolution adopted on the 19th day of December,
1974, the City Council of the City of San Rafael rejected all construc-
tion bids received on September 19, 1974, because the Army Corps of
Engineers' permit had not been issued within the ninety (90) day period
provided for the award of the construction contract; and the Council
directed the readvertisement for bids in this district to be received
on the 16th day of January, 1975;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of San Rafael, Marin County, California, that the Engineer of Work
be, and he is hereby directed to file a Third Amended Engineer's
Report to conform to the bid received on January 16, 1975.
I HEREBY CERTIFY that the foregoing resolution was duly and
regularly adopted by the City Council of the City of San Rafael, Marin
County, California, at a regular meeting thereof, held on the 24th
day of February, 1975, by the following vote, to wit:
AYES: Councilmen• Jensen Miskimen and Mulryan
NOES: Councilmen-: None
ABSENT: Councilmen• Nixon and Mayor Bettini
