RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL AUTHORIZING AND DIRECTING THE CITY
MANAGER TO EXECUTE TRAINING AGREEMENTS BETWEEN
THE POLICE DEPARTMENT OF THE CITY OF SAN RAFAEL
AND THE STATE OF CALIFORNIA DEPARTMENT OF HIGH-
WAY PATROL.
WHEREAS, The State of California Department of Highway Patrol
requires written training agreements from any agency participating in their
training programs; and
WHEREAS, the Police Department of the City of San Rafael de-
sires from time to time to participate in certain training programs sponsored
and administered by the California Department of Highway Patrol; and
WHEREAS, resolution of the San Rafael City Council is re-
quired for the 1974/75 and 1975/76 fiscal years.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of San Rafael, California does hereby authorize and direct the City
Manager to sign such training agreements when required for the fiscal
years 1974/75 and 1975/76.

AGREEMENT
THIS AGREEMENT, made and entered into this 10th day of February,
1975, by and between the State of California, acting by and through the
Department of California Highway Patrol hereinafter called CHP, and
the City of San Rafael hereinafter called contractor.
WHEREAS, the contractor requests that certain officers of the
Police Department be allowed to attend Motorcycle Training Class II -75,
conducted by CHP at the California Highway Patrol Academy; and
WHEREAS, CHP is willing to furnish such training services and
to allow certain officers of the Police Department to use its Academy
facilities while attending said motorcycle training class.
NOW, THEREFORE, the parties do hereby agree as follows:
1. This agreement shall become effective upon CHP's receipt of
a signed agreement and resolution. At that time the Police Department
shall become authorized to utilize the Academy facilities for attending
motorcycle training classes subject to training space available during
the period March 18-28, 1975.
2. CHP agrees to provide living, dining, and classroom facilities
at a daily rate of Fifteen Dollars and Fifty Cents ($15.50) per student
for resident students; the Motorcycle Training Program is provided by
California Highway Patrol instructors at a daily rate of Forty-eight
Dollars and Seventy Cents ($48.70) per student, based on an eight-hour
training day.
3. As consideration for the use of the Academy facilities,
contractor agrees to pay to CHP upon receipt of an invoice an amount
not to exceed Seven Hundred Ten Dollars ($710.00).
4. This agreement may be amended by mutual consent of the
parties hereto.
5. Contractor shall be responsible for paying any cost
incurred by CHP for facility damage caused by the willful or malicious
misconduct of trainees.
6. Contractor agrees to indemnify, defend, and save harmless
California Highway Patrol, its officers, agents, and employees from
any and all claims and losses accruing or resulting to any and all
contractors, subcontractors, materialmen, and any other person, firm,
or corporation furnishing or supplying work, services, materials, or
supplies in connection with the performance of this agreement, and
from any and all claims and losses accruing or resulting to any
person, firm, or corporation who may be injured or damaged by the
contractor in the performance of this agreement.
7. Notices and communications hereunder shall be sent to the
addresses appearing below the signatures.
