RESOLUTION AUTHORIZING EXECUTION OF DEED IN THE FORM
ATTACHED HERETO AS EXHIBIT "B" CONVEYING THOSE CERTAIN
UNDERGROUND ELECTRIC DISTRIBUTION AND STREET LIGHTING
FACILITIES HERETOFORE INSTALLED AND CONSTRUCTED IN THE
BAHIA DE RAFAEL INDUSTRIAL PARK ASSESSMENT DISTRICT
WHEREAS, on the 3rd day of October, 1973, the City of San Rafael
entered into an Agreement with McKeon Construction Company and Pacific Gas and
Electric Company for the installation and construction of certain underground
electric distribution and street lighting facilities in the Bahia De Rafael
Industrial Park Assessment District; and
WHEREAS, said underground electric distribution and street lighting
facilities have, in fact, been installed, constructed, and completed; and
WHEREAS, pursuant to the above-mentioned Agreement, the City of
San Rafael and McKeon Construction Company, upon installation of the electric
facilities, shall execute and deliver to Pacific Gas and Electric Company a deed
in the form attached hereto as Exhibit "B" conveying the electric facilities to
Pacific Gas and Electric Company;
NOW, THEREFORE, IT IS HEREBY ORDERED AND RESOLVED that the Mayor and
the City Clerk be authorized and directed to execute the deed in the form attached
hereto as Exhibit "B", and upon execution, the Department of Public Works shall
transmit said deed to Pacific Gas and Electric Company.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify
that the foregoing Resolution was duly and regularly introduced and adopted at
a regular meeting of the Council of said City on Monday, the 17th day of March,
1975, by the following vote, to -wit:
AYES: COUNCILMEN: Jensen, Nixon and Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Miskimen and Mulryan
