HomeMy WebLinkAboutResolution No. 4959RESOLUTION NO. 4959 A RESOLUTION AUTHORIZING THE SIGNING OF A LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a lease or agreement with Board of Supervisors of the County of Marin - Purchase of Tax Deeded Property (14-171-35 and 165-010-60) A copy of which is hereby attached and by this reference made a part hereof. I, MARION A. GRADY, City Clerk of the City of San Rafael, here- by certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of said City held on Monday the 5th day of May , 19 75 , by the following vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: Nixon MARION A. GRADY - City Clerk AGREEMENT FOR THE PURCHASE OF TAX DEEDED PROPERTY BY THE CITY OF SAN RAFAEL FROM THE COUNTY OF MARIN PURSUANT TO THE PROVISIONS OF DIVISION 1, PART 6, CHAPTER 8 OF THE REVENUE AND TAXATION CODE. THIS AGREEMENT, made and entered into this day of 1975, by and between the CITY OF SAN RAFAEL, a municipal corporation, hereinafter called "City" and the BOARD OF SUPERVISORS OF THE COUNTY OF MARIN, and the COUNTY OF MARIN, hereinafter jointly called the "Board". W I T N E S S "E "T H: WHEREAS, the Tax Collector of the County of Marin has deeded to the State of California for delinquent taxes, all of those lots or parcels of real property as set forth in Exhibit "A" attached hereto and made a part hereof as if set forth in full herein; and WHEREAS, such deed to the State for taxes includes taxes levied by the County of Marin and the City of San Rafael, the taxes of which on the property are collected by the County officers; and State: WHEREAS, City desires to purchase said real property from the County NOW THEREFORE, the parties hereto do hereby agree as follows: 1. The City agrees to pay to the Board the sum of Ten Dollars ($10.00) as and for full consideration for the purchase of said real property and promises and agrees to pay said sum forthwith upon the expiration of the redemption period provided by law, and in no event later than the execution and delivery of a deed from the Tax Collector of the County of Marin to the City, covering said real property. 2. The Board agrees to sell said real property to the City for the consideration above set forth, subject, however, to the approval of the State Controller of the State of California and to redemption rights and to take pro- ceedings to consummate such sale under the provisions of Chapter 8, Part 6, Division 1 of the Revenue and Taxation Code of the State of California. 3. Upon the taking of said proceedings, the City agrees to pay to the Board or to the County Tax Collector of the County of Marin, all publication and other costs of taking such proceedings and agrees to pay such sums upon demand and in addition to the consideration mentioned in paragraph 1. hereof.
